Superannuation (Continuing Contributions for Benefits) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Commencement

1.1   These Regulations are taken to have commenced on 18 December 1992.

2.    Amendment

2.1   The Superannuation (Continuing Contributions for Benefits) Regulations are amended as set out in these Regulations.

3.    Schedule 1 (Modifications of Act)

3.1   Item 1:

Inserted section 124d (Repayment of benefits):

Omit the inserted section, substitute:

Benefits not payable in certain circumstances

 “124d. If a benefit becomes, or became, payable under this Act to, or in respect of, a person to whom this Part applies on the commencement of any period that is, in relation to that person, a relevant period:

  • (a)

    the benefit is taken not to be, or to have been, payable; and

  • (b)

    if the benefit or any part of the benefit is paid, the person must repay the amount of that benefit or that part of the benefit to the Commissioner.”.
