Superannuation (Continuing Contributions for Benefits) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Amendment

1.1   The Superannuation (Continuing Contributions for Benefits) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Interpretation)

2.1   Insert the following definitions:

“ ‘performance pay’ means a payment of that name made under an industrial agreement under Division 3a of Part VI of the Industrial Relations Act 1988;”.

3. Regulation 3 (Classes of persons to which section 14a of the Act does not apply

3.1   Subparagraph 3 (1) (d) (iii):

After “of the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

4.   Regulation 3a (Classes of persons to which section 14a of the Act applies)

4.1   Subparagraph 3a (a) (v):

After “of the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

4.2   Subparagraph 3a (d) (iii):

After “of the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

4.3   Subparagraph 3a (e) (iv):

After “under the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

4.4   Subparagraph 3a (f) (iii):

After “under the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

5.   Regulation 4 (When s.14a no longer applies)

5.1   Subparagraph 4 (1) (c) (ii):

After “of the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

5.2   Paragraph 4 (5) (c):

After “under the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.

5.3   Paragraph 4 (6) (b):

After “under the Act”, insert “or a scheme to which the person contributes only in relation to performance pay”.
