Act No. 86, 1978.

An Act to amend section 11 of the Superannuation Act, 1916, to enable a person who re-enters the public service of New South Wales after he ceases to be a member of the Legislative Council to resume contributing to the Fund. [Assented to, 11th September, 1978.]

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.     This Act may be cited as the “Superannuation (Constitu-Short title,

tion) Amendment Act, 1978”.

The Superannuation Act, 1916, is amended

(a)

by omitting from section 11 (3) the words “Legislative sec. it. Assembly” and by inserting instead the words (Commence-

by omitting from section 11 (3) the words “re-entered or re-enters the said public service within two months after he ceased or ceases to be a member of that Assembly” and by inserting instead the words “re-enters the said public service within 2 months after he ceases to be such a member”;

(c) by omitting from section 11 (3) the words “Board—

(i)   where he re-enters the said public service as aforesaid after the commencement of the Superannuation (Amendment) Act, 1957— within two months after the date of re-entry;

(ii)   where he re-entered the said public service as aforesaid before that commencement—within two months after that commencement,

and shall take effect from the date upon which it is so received.” and by inserting instead the words “Board within 2 months after he re-enters the said public service as aforesaid and shall take effect from the date on which it is so received.”.
