I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 92 of the Superannuation Act

1916, make the following Order.

Explanatory note

Currently, certain disability services employees whose employment was transferred to a person in the
non-government sector (within the meaning of the National Disability Insurance Scheme (NSW Enabling)
Act 2013) between 1 July 2017 and 30 June 2018 can continue to be contributors to the State Superannuation

Fund. The object of this Order is to extend the transfer period to enable other transferred employees to continue to be contributors to that Fund.

This Order is made under section 92 of the Superannuation Act 1916.

1      Name of Order

This Order is the Superannuation Amendment (NDIS) Order 2018.

2      Commencement

This Order is taken to have commenced on 1 July 2018 and is required to be published on the NSW legislation website.

3 Amendment of Superannuation Act 1916 No 28

Schedule 3 List of employers

Omit “30 June 2018” from the matter relating to any person in the non-government
sector (within the meaning of the National Disability Insurance Scheme (NSW

Enabling) Act 2013) in Part 1.

Insert instead “30 June 2022”.
