Superannuation Amendment (ARTC

Employees) Order 2004

MARIE BASHIR, Governor I, Professor Marie Bashir AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 92 of the Superannuation Act 1916, make the following Order.

Explanatory note
The object of this Order is to amend the Superannuation Act 1916 to provide for certain former employees of Rail Infrastructure Corporation, RailCorp or the State Rail Authority who become employees of Australian Rail Track Corporation Ltd to continue to be contributors to the State Superannuation Scheme if:

(a)

they become so employed on or after 1 June 2004 and not later than 30 days after the commencement of the first lease of State rail infrastructure to that Corporation, and

(b)

they do not elect to cease to be contributors to the State Superannuation Scheme within 30 days after the commencement of the lease referred to in paragraph (a).

This Order is made under section 92 of the Superannuation Act 1916.

1      Name of Order

This Order is the Superannuation Amendment (ARTC Employees)
Order 2004.

2      Commencement

This Order is taken to have commenced on 1 June 2004.

3 Amendment of Superannuation Act 1916

The Superannuation Act 1916 is amended by inserting at the end of
Part 1 of Schedule 3 the following matter:

Australian Rail Track Corporation Ltd (limited to those persons who:

(a)

become employees of Australian Rail Track Corporation Ltd on or after 1 June 2004 and not later than 30 days after the commencement of the first lease entered into by any rail authority under section 88B of the Transport Administration Act 1988, and

(b)

cease to be employed by Rail Infrastructure Corporation, RailCorp or the State Rail Authority not more than 30 days before being so employed, and

(c)

do not elect to cease to be contributors to the Fund within 30 days after the commencement of the lease referred to in paragraph (a)).
