His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Superannuation Administration Act 1996.

The object of this Regulation is to make provision for the determination of certain disputes involving persons who are members of the local government superannuation scheme established by trust deed in accordance with section 127 of the Superannuation Administration Act 1996. The disputes concerned are disputes about the rights and obligations of those persons under FTC or STC schemes to which they formerly belonged by reason of service with an employer who has since become associated with the local government superannuation scheme. The Regulation provides that such disputes are to be resolved by the trustee of the local government superannuation scheme. This Regulation is made under sections 22 and 67 of the Superannuation Administration Act 1996 (as inserted by the Superannuation Legislation Further Amendment Act 1998) and section 129 of that Act (the general regulation-making power).

1 Name of Regulation

19 Disputes concerning entitlements or obligations of

transferred members or associated beneficiaries under
FTC schemes

A dispute concerning the entitlements or obligations of a transferred member or beneficiary arising in respect of service by the transferred member, before the transfer day, with a transferred employer who was responsible for the payment of benefits under an FTC scheme in respect of that service are to be determined, not by FTC, but by the trustee of the local government superannuation scheme.

A dispute concerning the entitlements or obligations of a transferred member or beneficiary arising in respect of service by the transferred member, before the transfer day, with a transferred employer who was responsible for the payment of benefits under an STC scheme in respect of that service are to be determined, not by STC, but by the trustee of the local government superannuation scheme.
