Explanatory note

The object of this Regulation is to amend the Superannuation Administration (Electricity Superannuation Scheme Transitional Provisions) Regulation 1997 to transfer certain employees of Pacific Power, as part of the handover of staffing responsibilities in certain facilities by Pacific Power to the Snowy Mountains Hydro-electric Authority, from their existing public sector superannuation schemes to the superannuation scheme established for the electricity industry by trust deed under the Superannuation Administration Act 1996. The transfer will take place on 5 December 1997.

This Regulation is made under the Superannuation Administration Act 1996,

including section 128 and section 129 (the general regulation making
power).

This Regulation commences on 5 December 1997.

The Superannuation Administration (Electricity Superannuation Scheme Transitional Provisions) Regulation 1997 is amended as set out in Schedule l .

Insert after clause 5:

5A Transfer of certain employees only of Pacific Power

(1)

Despite clause 5 ( l), a person who is an employee of Pacific Power is transferred from a superannuation scheme referred to in clause 6, 7, 8, 9 or 10 to the electricity superannuation scheme by operation of that

clause only if:  I

(a) 

the person is an employee who was, immediately before 5 December 1997, seconded to the Snowy Mountains Hydro-electric Authority or working on the Snowy Mountains Hydro-electric Scheme or employed in connection with the trading of electricity generated by the Scheme, and

(b) 

the person is approved by the Minister for the purposes of this clause, or is a member of a class of persons approved by the Minister for the purposes of this clause.

(2) In this clause:
Snowy Mountains Hydro-electric Authority means the Snowy Mountains Hydro-electric Authority referred to in the Snowy Mountains Hydro-electric Power Act I949
of the Commonwealth.
