REGULATIONS UNDER THE SUPERANNUATION ACT 1976*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Superannuation Act 1976.

AMENDMENTS OF THE SUPERANNUATION (ADDITIONAL PENSION) REGULATIONS 

Commencement

1. These Regulations shall be deemed to have taken effect from and including 1 July 1976.

2. The Superannuation (Additional Pension) Regulations are amended by inserting after regulation 5 the following regulations:

Factor applicable for purposes of subsections 61 (1) and (2) of the Act

“ 6. For the purposes of sub-section 61 (3) of the Act, the factor applicable to a person for the purposes of sub-sections 61 (1) and (2) of the Act is the factor specified in column 2 of Schedule 3 opposite to the age specified in column 1 of that Schedule that was that person’s age on his last day of service.

Percentage applicable for purposes of definition in subsection 61 (4) of the Act

“ 7. For the purposes of the definition of ‘ notional final annual rate of salary ’ in sub-section 61 (4) of the Act, the percentage applicable to a person is the percentage specified in column 3 of Schedule 3 opposite to the age specified in column 1 of that Schedule that was that person’s age on his last day of service.”.

3. The Superannuation (Additional Pension) Regulations are Schedule 3 amended by adding at the end thereof the following Schedule:
