(1) Subject to this section, this Act comes into

22F. Obligation on Board

(1) Subject to sub-sections (5) and (6), the Board

ts must comply with this section if—
n (a) a superannuation agreement which
e provides for a payment split; or
m (b) a flag lifting agreement which provides

c for a payment split; or
o (c) a splitting order—

o respect of the superannuation interest less
any payments previously made by the Board

o satisfied as at that commencement.
D (3) If the non-member spouse has not satisfied a
ry relevant condition of release and the member
ta spouse is not receiving a pension under this
Act, the Board must if the value of the non-

e member spouse's entitlement in respect of
the superannuation interest at the particular

ia time does not exceed the value of the
rl member spouse's interest in the Fund—
a (a) transfer a lump sum amount equal to
P the value of the non-member spouse's
