GORDON SAMUELS, Governor I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 92 of the Superannuation Act 1916, make the following Order.

Explanatory note
Under the Superannuation Act 1916 (the Act), employers are required to make superannuation contributions in respect of their employees to the State Superannuation Fund.
Before 1 July 1999, the Australian Red Cross Society (the Society) was the employer, for the purposes of the Act, of the staff of its NSW Blood Transfusion Service (the Service) because the Society was a public health organisation, within the meaning of the Health Services Act 1997, in respect of the Service. From 1 July 1999, the Society is no longer a public health organisation in respect of the Service.

Explanatory note
Further, on 1 July 1999 the staff of the Service became staff of the Australian Red in-Council, by Order, to amend Schedule 3. Section 92 (2) (a) allows such an Order to be made with effect on and from a day that is earlier than the day the Order is published in the Gazette, and section 92 (2) (b) allows the Order to effect the amendment with such limitations as are specified in the amendment (provided the limitations do not operate to the prejudice of an existing contributor).
Cross Blood Service of the Society.
The object of this Order is to ensure the continued application of the Act in respect
of those members of the staff of the Australian Red Cross Blood Service who were,
before 1 July 1999, members of the staff of the NSW Blood Transfusion Service.
It achieves this object by amending Schedule 3 to the Act (which lists the
organisations and bodies who are employers for the purposes of the Act).

This Order is the Superannuation (Australian Red Cross Blood
Service) Order 1999.
2 Commencement
This Order is taken to have commenced on 1 July 1999.

Schedule 3 to the is amended by inserting employed in the Australian Red Cross Blood Service and who were, immediately before 1 July 1999, employed in the NSW Blood Transfusion Service of the Society)
at the end of Part 1 of that Schedule the following words:
