SUPERANNUATION ACT 1916—ORDER
NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 92 of the Superannuation Act 1916, do, by this my Order, amend Schedule 3 to that Act (Employers), with effect on and from 2 November 1994, by inserting at the end of Part 1 of that Schedule the following name and limitation:
Port Macquarie Base Hospital
(limited to those persons:
(a) who were, immediately before 2 November 1994:
(i) employees of Hastings District Hospital, Port Macquarie; and
(ii) contributors to the State Superannuation Fund; and
(b) who, on that date:
(i) transferred their employment to Port Macquarie Base Hospital; and
(ii) did not cease to be contributors to that Fund).

EXPLANATORY NOTE
Under the Superannuation Act 1916, employers within the meaning of the Act are required to make superannuation contributions in respect of certain of their employees to the State Superannuation Fund. Schedule 3 to the Act lists organisations and bodies that are employers for the purposes of the Act. Section 92 of the Act authorises the Governor-in-Council, by order, to amend the Schedule. The purpose of this Order is to include Port Macquarie Base Hospital in the list of employers. However, the Act will apply only to those employees of the Hospital who were contributors to the State Superannuation Fund on 2 November 1994, the date on which the employment of those employees was transferred from Hastings District Hospital to Port Macquarie Base Hospital.
