SUPERANNUATION ACT 1916—ORDER

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of sections 62 and 92 of the Superannuation Act 1916, do, by this my Order:
(a)
amend Schedule 3 to that Act (List of Employers), to take effect on and from 24 February 1995, by inserting at the end of Part 1 of that Schedule the following names:
Jemalong Wyldes Plains Irrigation Limited
Lower Murray Irrigation Areas Limited
Murray Irrigation Limited(b)
on and from 3 March 1995, by omitting the following names:
Jemalong Wyldes Plains Irrigation Limitedamend Schedule 3 to that Act (List of Employers), to take effect Murray Irrigation Limited

EXPLANATORY NOTE
Under the Superannuation Act 1916, employers within the meaning of the Act are required to make superannuation contributions to the State Superannuation Fund in respect of certain of their employees. Schedule 3 to the Act lists organisations and bodies that are employers for the purposes of the Act. Section 92 of the Act authorises the Governor-in-Council, by order, to amend the Schedule by inserting the name of a corporation. Section 62 of the Act authorises the Governor-in-Council, by order, to omit the name of an employer if the removal is a consequence of a Government privatisation initiative affecting the employer.
The purposes of this Order are:
• to include three irrigation corporations—Jemalong Wyldes Plains Irrigation Limited, Lower Murray Irrigation Areas Limited and Murray Irrigation Limited—in the list of employers. These irrigation corporations became State owned corporations (under the State Owned Corporations Act 1989) on 24 February 1995; and
• to remove the names of the same three irrigation corporations from the list of employers, effective one week later. The corporations were privatised (under the Irrigation Corporations Act 1994) on 3 March 1995.
The effect of the Order is to require the named employers to make contributions in respect of their employees for the period between 24 February 1995 and 3 March 1995. (Sections 62 (2) and 92 (2) of the Act authorise an Order to be made so that it has effect on and from a date that is earlier than the date of its publication).
