SUPERANNUATION ACT 1916—ORDER

NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 92 of the Superannuation Act 1916, do, by this my Order:

(a) amend Part 1 of Schedule 3 to that Act (List of Employers), to take effect on and from 9 December 1964, by inserting at the end of that Part the following name and limitation:

Totalizator Agency Board (limited to officers of the Board to whom section 9 (2) (c) of the Totalizator (Off-course Betting) Act 1964 applies)

(b)

amend Part 1 of that Schedule, to take effect on and from 14 May 1990, by inserting after the item relating to the Totalizator Agency Board the following name and limitation:

State Bank of New South Wales Limited (limited to:

(a)

contributors in respect of any period during which they have been employees of the Bank from and including 14 May 1990 (but only if they were employees of the Bank on 18 December 1992); and

(b)

other contributors in respect of any period during which they were employees of the Bank from and including 14 May 1990 and before 18 December 1992)

(c)

amend Part 1 of that Schedule, to take effect on and from 15 November 1992, by omitting the item relating to Trustees of state recreation areas and by inserting instead the following names:

Trustees of Arakoon State Recreation Area
Trustees of Bent’s Basin State Recreation Area
Trustees of Burrendong State Recreation Area
Trustees of Burrinjuck State Recreation Area

Trustees of Copeton State Recreation Area
Trustees of Lake Glenbawn State Recreation Area
Trustees of Grabine State Recreation Area

(d)

amend Part 2 of that Schedule, to take effect on and from 1 July 1989, by inserting at the end of that Part the following name:

Local Government Electricity Association of New South Wales

(e)

amend Part 2 of that Schedule, to take effect on and from 1 July 1989, by inserting after the item relating to the Local Government Electricity Association of New South Wales the following name and limitation:

Government Employees Health Club (limited to:

(a) contributors in respect of any period during which they have been employees of the employer from and including

1 July 1989 (but only if they were employees of the

employer on 18 December 1992); and

(b)

other contributors in respect of any period during which they were employees of the employer from and including 1 July 1989 and before 18 December 1992)

(f)

amend Part 2 of that Schedule, to take effect on and from 1 July 1993, by omitting from that Part the figure “1919” where firstly occurring and by inserting instead the figure “1993”;

(g)

amend Part 2 of that Schedule, to take effect on and from 1 July 1993, by omitting the matter “section 562 of the Local Government Act 1919” and by inserting instead the matter “the Local Government Act 1993”;

(h)

amend Part 2 of that Schedule, to take effect on and from 1 July 1993, by omitting from that Part the matter:

An urban committee established under section 548 of the Local

Government Act 1919

A joint committee established by an agreement entered into

under section 521 of the Local Government Act 1919

and by inserting instead the following matter:

An electricity distributor constituted under the Electricity Act

1945

(i) amend Part 2 of that Schedule, to take effect on and from 1 July 1990, by omitting the matter “A pastures protection board established under section 6 of the Pastures Protection Act 1934” and by inserting instead the matter “A rural lands protection board constituted under the Rural Lands Protection Act 1989”;

(i)amend Part 2 of that Schedule, to take effect on and from 1 July

1993, by inserting at the end of that Part the following names:

Waverley- Woollahra Destruction Committee
Richmond-Tweed Regional Library
Richmond-Upper Clarence Regional Library

EXPLANATORY NOTE

Under the Superannuation Act 1916 employers within the meaning of the Act are required to make superannuation contributions to the State Authorities Superannuation Fund in respect of certain of their employees. Schedule 3 to the Act lists organisations and bodies that are employers for the purposes of the Act. Section 92 of the Act authorises the Governor-in-council, by Order, to amend the Schedule in certain circumstances. The purpose of this Order is to bring the Schedule up to date so as to reflect the current names or descriptions of those employers and to add the names of certain other employers.

Where appropriate, the Order will have retrospective effect on and from the date on which the relevant change or addition actually occurred or took effect. (Subsection (2) of the section authorises an Order to be made so that it has effect retrospectively.)
