[ASSENTED TO 29TH DECEMBER, 1916.J B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lativeOouncil and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. After section eleven of "The Sugar Works Amendinent Guar antee Ac ts Amendment Act of 1908,"* the following oVfI8I.ENdow. . 10. sectIons are InSerted:- [11A.] For the purposes of the Principal Acts and Pow,:rto this Act, the Corporation shall have power from time to acqwreland. time to take, purchase, contract for the use of, or other- wise provide any land which may be required for any sugar works, or for tramway, railway, road, drainage, wharfage, or any other purposes. . The powers under this section shall be exercised under "The Public Works Land Resumption Act of 1906" t : Provided that, in estimating the compensation to be paid on the resumption or other acquirement of land by the Corporation, no allowance shall be made for any increase in the value of such land by reason of the construction or proposed construction of any works or other matter arising out of the exercise of powers under the Principal Acts or this Act. [lIB.] The Corporation may construct, lay down, Power to maintain, and work any tramway or railway upon any construct, road or land, including Crown land, and may use thereon ~ ~ : nways. any locomotives and rolling-stock drawn or propelled by animal, steam, or other motive power. The Corporation, with the approval of the Governor in Council signified by Order in Council, may carry for hire upon any tramway for the time being vested in or under the control of the Corporation passengers, goods, live stock. and material for the public. Such Order in Council shall prescribe such conditions and provisions relating to- (a) The proper working, maintenance, and use of the tramway; (b) The regulation of. the traffic thereon; (c) The limitation of liability in respect of pas- sengers, goods, live stock, or material carried or· to be carried thereon; (d) The rates, tolls,fares, and charges,and the mode of recovery of the same; (e) Such other matters relating to the tramway; as the Governor in Council thinks proper. * 8 Edw. Aft.er the first paragraph of subsection six of o N f o. 28G, e B o . . 9V. . section nine of "The Sugar Works Act of 1911,"* the following paragraph is inserted:- For the purposes of this Act, the Corporation shall have power from time to time to· take, purchase, contract for the use of, or otherwise acquire any existing tramway, wharf, or other work. (2.) In the second paragraph of the said subsection six, the words "by the Corporation within a sugar works area" are repealed, and the words "or any existing tramway, wharf, or other work by the Corporation" are inserted in lieu thereof; and after the words "such land" the words "or work" are inserted.· (3.) The following provision is added to subsection seven of the said section:- The Corporation, with the approval of the Governor in Council signified by Order in Council, may carry for hire upon any tramway for the tjme being vested in or under the control of the Corporation passengers, goods, live stock, and material for the public. Such Order in Council shall prescribe such conditions and provisions relating to- (a) The proper working, maintenance, and use of· the tramway; (b) The regulation of the traffic thereon; (c) The limitation of liability in respect of pas- sengers, goods, live stock, or material carried or to be carried thereon; (d) The rates, tolls, fares, and charges, and the mode of recovery of the same; (e) Such other matters relating to the tramway; as the Governor in Council thinks proper. Amendment 4. The following subsection is added to section ten ~ o~ ~e~ ~.io, of" The Sugar Works Act of 1911"*:- 16. (4.) If at any time while the sugar works are vested in the Corporation an adjustment is required, either by way of reduction of or addition to the capital cost of the sugar works as already certified to, the Corporation may, by a like certificate, make such adjustment as shall be proper; a:nd thereafter the amount stated in such certifi- cate as the capital cost after such adjustment shall be deemed to be the capital cost of the sugar works. • 2 Geo. The following paragraph is added to section sixteen of the said Act :- If the Corporation makes any adjustment of capital cost as provided by section ten of this Act, interest at the rate aforesaid shall be calculated on the amount of the capital cost after such adjustment, and t,he amounts of the annual instalments payable to the Treasurer as afore- said shall be proportionately increased or reduced as the case may require. But no such adjustment shall have the effect of altering the date on and from which the payment of interest or repayment of capital cost with interest as herein provided is to commence. 5. (1.) After the first paragraph of subsection seven Amendment of section seven of. "The Oo- opera: ti~ e Sugar Works Act of~ o~ ~t~.~ : 1914,"* the followmg paragraph IS mserted:- For the purposes of this Act, the Corporation shall have power from time to time to take, purchase, contract for the use of, or otherwise acquire any existing tramway, wharf, or other work. (2.) In the second paragraph of the said subsection, after the word" land" where it first occurs, the words "or any existing tramway, wharf, or other work" are inserted; and after the words "such land" the words "or work" are inserted. (3.) The following provision is added to subsection eight of the said section:- The Corporation, with the approval of the Governor in Council signified by Order in Council, may carry for hire upon any tramway for the time being vested in or under the oontrol of the Corporation, passengers, goods, live stock, and material for the public. Such Order in Council shall prescribe such conditions and provisions relating to- (a) The proper working, maintenance, and use of the tramway; (b) The regulation of the traffic thereon; (c) The limitation of liability in respect of pas- sengers, goods, live stock, or material carried or to be carried thereon; (d) The rates, tolls, fares, and charges, and the mode of recovery of the same; * 5 Geo.
