And generally the powers, authorities, jurisdiction, and duties conferred and imposed respectively upon land commissioners and land rangers by the Principal Act shall respectively be conferred and imposed upon prickly- pear wardens and prickly-pear rangers appointed under this Act. 35. THE SUGAR WORKERS' PERPETUAL LEA~ E SELECTIONS . ACT OF 1923. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as "The Sugar Worker8' Short Perpetual Lea8e Selection8 Act of 1923," and shall be read ~ ~ ~ ~ t: ~ tion as one with *" The Land Act8, 1910 to 1922," herein of Act. . collectively referred to as the Principal Act. 2. In this Act the term "Sugar worker" means a I~ terpreta. male person who is employed as an employee mainly in ~ ~ ~ ~ ugar a sugar works or in field work in connection with the growing and harvesting of sugar-cane; the term " Sugar works" means any mill for the extraction and manufacture .. 1 Geo. No. 20, of sugar and the by-products thereof, together with all machinery, chattels, and appurtenances used therein or in connection therewith, and all tramways, wharves, structures and works occupied or used for the purposes of a sugar mill, and the mill site and all land used in connection with any such tramway, wharf, structure, or works; and generally all the terms used have the same meanings as are l'espectively assigned to them in the Principal Act. Power to open land for sugar workers. 3. The Minister may from time to time, by notifi- cation, open any Crown land for Group Selection as Perpetual Lease Selections under this Act and the Principal Act, and for this purpose the following provisions shall apply :- • (1) Only sugar workers who do not hold any land in Queensland, whether freehold or leasehold, other than freehold or leasehold land situated within any city, township, or other centre of population, or which has been declared to be suburban land under section thirteen of the. Principal Act, shall be qualified to apply for or acquire a Perpetual Lease Selection under this Act. Provisions of Principal Act appliea ble. (2) All the provisions of the Principal Act relating to Perpetual Lease Selections shall apply to the opening of land under this Act as Perpetual Lease Selections and to licenses to occupy selections and to such selections respectively selected, acquired, and held under the Principal Act and this Act with, however, the following modifications, namely :- (a) Notwithstanding anything in section fifty- six of the Principal Act contained, a Perpetual Lease Selection under this Act may contain such acreage not exceeding thirty acres as the Minister may determine; (b) Section seventy-eight of the Principal Act shall, for the purposes of this Act, be read and construed as if the words "three years" were substituted for the words" five years," and as if in the first paragraph thereof the word" either" and the words "or make substantial improvements on the land of a value equal to the cost of such a fence" were omitted therefrom ;

(c) The selection shall be subject to a condition that the selector shall himself bona fide personally reside on the selection for at least six months continuously in every year during the whole currency of the lease: Provided that while the selector himself bona fide personally resides upon and is himself beneficially interested in any town, suburban, or country land situated at a distance not exceeding fifteen miles from the nearest part of the selection, he shall for the purposes of this provision be deemed to be himself personally bona fide residing on the selection ; (d) Notwithstanding anything contained in the Principal Act the selector, with the consent of the Minister, shall not be debarred from transferring to another qualified sugar worker his interest in the selection at any time after the issue to him of his license to occupy, and the transferee shall thereupon perform. all the conditions which by this Act and the Principal Act are required to be performed by the selector; (6) If at any time the selector ceases to be a sugar worker the Minister may, by notice in writing, require him to transfer his interest in the selection and the lease thereof (if issued) or the license to occupy to another qualified sugar worker. In the event of a selector being required by the Minister so to transfer his selection, he shall effect such transfer within twelve months from the date of such notice, and if he fails so to do his interest in the selection, with all improve- ments and the lease thereof (if issued) or the license to occupy, and all the rights, if any, of the selector may, without any further notice or process, be forfeited in the discretion of the Minister, and the selector shall have no further right or claim upon or in relation to the selection or any improvements thereon : Provided that the Minister may in his discre- tion, and upon good cause being shown, grant such extension of time, not exceeding twelve months, for the transfer of the selection as he may deem fit. 10631

Any sugar worker who is the holder of a special ~ ~ e; ~ ~: : !~ S lease of land under the Principal Act, the lease whereof tenure. is subsisting at the passing of this Act, shall, subject to the approval of the Minister, at any time after the passing of this Act, be entitled to surrender such lease and to have the same land opened for selection as a Perpetual Lease Selection under this Act and the Principal Act, with priority of application to him; Pro- vided, however, that such sugar worker shall, within one month from the date of opening or within such further time as the Minister may allow, complete his application to select the portion. Upon such surrender and selection the Minister shall make every necessary adjustment of rent and survey fee paid as between the Crown and the selector. State advances. 5. Any selection selected, acquired, or held under this Act and the Principal Act shall be deemed a security on which advances may be made to the holder thereof under the State laws in force for the time being relating to State Advances for workers' dwellings or in respect of agricultural land or farm land. Regulations. 6. The Governor in Council may from time to time make regulations for the effective execution of this Act, and the provisions of section two hundred and nine of the Principal Act shall apply to such regulations. 14 Geo.
