This guideline may be cited as the Sugar Industry (Mill Peak Adjustments) Guideline 1991 . Definitions 2. In this guideline— “home mill” means the mill from which an amount of mill peak is to be transferred by applying the formula mentioned in section 3; “initial aggregate” in relation to a mill, means the aggregate of the farm peaks set out in the Schedule attached to the award for the 1991 crushing season made by the Local Board constituted for the mill;

2 Sugar Industry (Mill Peak Adjustments) Guideline 1991 “initial mill peak” in relation to a mill, means the mill peak of the mill listed opposite the mill in the Schedule published at page 1072 of the Gazette on 2 March 1991 under the repealed Regulation of Sugar Cane Prices Act; “mill peak” in relation to a mill, means the mill peak of the mill under section 7.11 of the Act; “receiving mill” means the mill to which an amount of mill peak is to be transferred by applying the formula mentioned in section 3. Adjustment following farm peak transfer 3.(1) For the purposes of section 9.38 of the Act, to take into account a transfer under the Act of farm peak from an assignment the lands of which are assigned to 1 mill to an assignment the lands of which are assigned to another mill, the Corporation will transfer an amount of mill peak from the first mentioned mill to the second mentioned mill by applying the formula— MPA = FP R. (2) In subsection (1)— “MPA” (mill peak adjustment) means the amount to be subtracted from the mill peak of the home mill and added to the mill peak of the receiving mill; “FP” (farm peak) means farm peak— (a) that has been transferred under the Act from an assignment the lands of which are assigned to the home mill to an assignment the lands of which are assigned to the receiving mill; and (b) expressed in the same terms of tonnes of cane, tonnes relative ccs or otherwise as is expressed the farm peak of the initial aggregate of the home mill; “R” (ratio) means the figure set out opposite the name of the home mill in the Schedule, being in each case the figure established by dividing the initial aggregate of the home mill by the initial mill peak of the mill.
