STOCK-SUGAR. 249 .5 GEO. VI. No. 16, 1941. Sugar Experiment Stations, Etc., Act. (3.) All such Orders in Council and regulations shall be laid before Parliament forthwith if then sitting; and, if not then sitting, within fourteen days after the commencement of the next ensuing session. If Parliament, within the next fourteen sitting days after any such Order in Council or regulation has been so laid before it, resolves that such Order in Council or regulation ought to be annulled, the same shall after the date of such resolution be of no effect, without prejudice to the validity of anything done in the meantime under such Order in Council or regulation or to the making of any new Order in Council or regulation. For the purpose of this section the term "sitting days" shall mean days on which the House actually sits for the despatch of business. 14. This Part of this Act shall be read as one with of Part lI. *" The Sugar Experiment Stations Acts, 1900 to 1938, '~ Collective title. which Acts are in this Part referred to as the Principal Act. The Principal Act and this Part of this Act may be collectively cited as "The Sugar Experiment Stations Acts, 1900 to 1941." Amendment of 8. le. 3. The following paragraph is added to subsection one of section 1c of the Principal Act, namely :- "The provisions of this Act relating to alternate host plants shall be read and construed as being in aid of and not in derogation of §" The Diseases in Plants Acts, 1929 to 1937." " Amendment 4. In section two of the Principal Act the following ofs.2. definition " Alternate host plant" is inserted after the definition" Abandoned or neglected," namely:- Alternate host plant. The following paragraphs are hereby added to S1T9A0T0IOTNOS1 A 93 c 8 rs ." , section five of the Principal Act, namely : - Amendment OfB.5. "The officer appointed as Assistant Director of Sugar Experiment Stations shall be the deputy for the Director, and in the absence of the Director may exercise all or any of the powers, functions, duties and authority of the Director. The fact that the Assistant Director exercises any power, function, duty or authority of the Director shall be conclusive proof of the absence of the Director until the contrary is proved." 6. In the second paragraph of section six of the Amendment Principal Act the words " except any assessment levied of B. 6. under section 9D of this Act for Cane Pests Boards purposes OT any assessment levied under section thirty- two of this Act for Cane Disease Control Board purposes" are repealed and the words "except any assessment levied under this Act for Cane Pest and Disease Control Board purposes" are inserted in lieu thereof. 7. The following proviso is added to section Amendment fourteen of the Principal Act, namely :- of s. 14. " Provided further that, where he is of opinion that compliance with this section will inflict material hardship in any mill area by reason of the normal sugar-cane crop cycle in such area exceeding one calendar year or of any other special circumstances, the Minister may by a notice published in the Gazette extend to the fourth calendar year after the calendar year of planting the period within which cane-growers shall be entitled in pursuance of this section to grow and deliver to such mill such varieties of sugar-cane as are specified in such notice." 8. The words " or alternate host plant" are inserted Amendment after the word" sugar-cane" in subsection two of section of B. 20. twenty of the Principal Act. 9. The words "or alternate host plant" are Amendment inserted after the word " sugar-cane" where such last- of B. 22. mentioned word twice occurs in paragraph (b) of section twenty-two of the Principal Act.

The words "or alternate host plant" are inserted before the words " which he reasonably suspects" ; and (ii.) The words "or alternate host plants" are inserted before the words " reasonably suspected" where such last-mentioned words occur in the first paragraph of the said subsection one; and (iii.) The words "or any diseased alternate host plant" are inserted before the words "to take all such further." (b) In subsection three thereof the words "or alternate host plant" are inserted after the word " sugar-cane" where such last-mentioned word thrice occurs. Amendment 11. In subsection two of section twenty-seven of of s. 27 (2). the Principal Act the words "and/or alternate host plants" are inserted after the words "all sugar-cane," and the words " or are" are inserted before the words " likely to harbour." Amendment 12. Section twenty-eight of the Principal Act is of 8.28. amended as follows : - (a) In the first proviso to subsection one thereof the words "or part of a mill area" are inserted after the words " if a mill area" and the words " without defining the boundaries thereof" are repealed and the words " or, in the case of part of a mill area, the name of the mill concerned together with a description identifying such part without, in either case, defining the boundaries of the mill area or part of a mill area so declared " are inserted in lieu of such repealed words. (b) In subsection seven thereof the words "and/or alternate host plants" are inserted after the words" of a particular variety" and the words "or any such alternate host plant" are inserted after the words" of such particular variety."

April, one thousand nine hundred and forty-two: ~ ~ :: 1o: ~ ~ Provided that any power or authority conferred section. upon the Governor in Council or the Minister or the Advisory Board by the Principal Act as amended by this section may be exercised at any time after the passing of this Act for the purpose of bringing this section into force on the said first day of April, one thousand nine hundred and forty-two. (2.) Subject as hereinafter provided, sections 9A, Sections 9B, 9c, 9D, 9E, twenty-nine, thirty, thirty-one, and 9A J~ r 32 thirty-two of the Principal Act are repealed: : pealeJ~ Provided that, but without prejudice to *" The Acts Savings. Every Cane Pests Board and every Cane Disease Control Board constituted under the sections of the Principal Act repealed by this section or any of such repealed sections shall continue in existence, and every member of any such Board shall, subject to the Principal Act, continue in office up to and including the thirty-first day of March, one thousand nine hundred and forty-two, but * 31 V. 254 PART !I.- AMENDMENTS OF "THE SUGAR EXPERJ:MENT STATIONS ACTS, 1900 TO 1938." SUGAR. Sugar Experiment Stations, Etc., Act. 5 GEO. VI. No. 16, every such Board shall be abolished and every member of any such Board shall cease to hold office on and from the expiration of such last-mentioned date; (iii.) There is hereby constituted for every area which pursuant to paragraph (i.) of this proviso is deemed to be cane pest and disease infested a Cane Pest and Disease Control Board, and it is hereby declared that every such Board shall be deemed to be duly constituted under and for the purposes of the provisions of *" The Sugar Experiment Stations Acts, 1900 to 1941," relating to Cane Pest and Disease Cont.-rol Boards, and that all of the applicable provisions of such last- mentioned Acts shall apply and extend accordingly; (iv.) All moneys other than assessments which, having become due to a Cane Pests Board or a Cane Disease Control Board on or before the thirty-first day of March, one thousand nine hundred and forty-two, have not then been duly paid shall continue to be due and payable to and may be paid to and received and recovered by the Cane Pest and Disease Control Board constituted for the area concerned; (v.) All rights, liabilities, contracts, and engagements of a Cane Pests Board or Cane Disease Control Board existing at the thirty- first day of March, one thousand nine hundred and forty-two, shall be and continue to be vested in and shall attach to and may be enforced by or against the Cane Pest and Disease Control Board constituted for the area concerned ; (vi.) All actions or proceedings pending at the thirty-first day of March, one thousand nine hundred and forty-two, by or against a Cane Pests Board or Cane Disease Control Board may be carried on and prosecuted by or against the Cane Pest and Disease Control Board constituted for the area concerned; * 64 V. S " prejudice the right to recover any penalty imposed thereunder and incurred before the coming into operation of this section; (viii.) All the assets and liabilities of a Cane Pests Board or Cane Disease Control Board shall, on and from the first day of April, one thousand nine hundred and forty-two (and without any conveyance or assignment other than this Act), devolve upon the Cane Pest and Disease Control Board constituted for the area concerned; (ix.) The provisions of section seven of *" The Sugar Experiment Stations Acts, 1900 to 1941," shall, so far as they are applicable, continue to apply to and with respect to any assessment made by the Minister under the sections of the Principal Act repealed by this Act or any of such sections; (x.) No member of any Cane Pests Board or Cane Disease Control Board shall have any right or claim for damages or otherwise howsoever against the Crown or the Minister or any other body or person whomsoever by reason of his going out of office in pursuance of this section. (3.) The Minister may from time to time by like notification- (a) Alter the boundaries of a cane pest and disease infested area, whether by exclusion of land therefrom or inclusion· therein of other land; (b) Combine two or more such areas into one such area whether or not such areas are contiguous; (c) Abolish any such area. * 6·1 V. Disease Control Board in and for any cane pest and disease infested area which shall be defined in such Order in Council. Every such Board shall consist of five members, three of whom shall form a quorum at any meeting of such Board. Three members of such Board shall be cane-growers. No person shall become or remain a member of such Board who is not or was not, within the twelve months next preceding, a cane-grower entitled to vote as hereinafter provided or a mill-owner or a representative of a mill-owner within such area. The members of such Board shall be elected by the mill-owners of the area electing two members and the cane-growers of the area electing three members. No cane-grower shall be entitled to a vote unless he is cultivating or usually or ordinarily cultivates an area of at least five acres of assigned land for the purposes of the sale or supply of sugar-cane to a sugar mill. Every such Board shall be elected for a period of three years, unless in the case of any such Board the Governor in Council determines by Order in Council that such Board shall be elected for a period less than three years. The time and mode of election of the members of such Board, and of the filling of any vacancy therein, shall be such as shall be fixed by the regulations. The regulations may provide for all or any matters or things necessary or convenient to enable such Board to conduct its business.

The powers and dutIes of a Cane Pest and 1900 TO 1938." tDhiesIe. rasaereCaoC ~ n o t r rolt BeoahsrudppsrheSa'lSlIOben taondtakperesvuecnht' IsOtenps 0 fwictahnine B Pdu o ° t a l, ! r ee d sr s s ° . fand pests and/or diseases as the Minister shall, from time to time upon the recommendation of the Advisory Board, determine and sanction: Provided that for the purpose of making such recommendation, the Advisory Board may make such inquiry as it shall think fit and shall in respect of such inquiry have and may exercise the powers, authorities, jurisdiction, and protection of a commission within the meaning of *" The Official Inquiries Evidence Acts, 1910 to 1929" : Provided further, that in any case where any sugar-cane or alternate host plants within a cane pest and disease infested area (not being diseased sugar-cane under and within the meaning of section thirteen, section fourteen, section fifteen, section eighteen, or section twenty-three of this Act, or sugar-cane or alternate host plants which is or are destroyed in the course of dealing with any land under section twenty-seven of this Act) is or are destroyed by or under the direction of the Minister or of an inspector, the Cane Pest and Disease Control Board may pay from its funds to the owner of such sugar-cane or alternate host plants such compensation as is adjudged reasonable by the Advisory Board, or, if the owner of such sugar-cane or alternate host plants is aggrieved by the decision of the Advisory Board and appeals to the Minister to have the matter referred to an assessor, by an assessor to be chosen by the Minister, and the decision of the assessor shall be final. The reasonable costs and expenses of any such assessment of compensation by an assessor shall be charged against and paid out of the funds of the Cane Pest and Disease Control Board. (2.) Proper books of accounts showing all moneys received and expended shall be kept by the Cane Pest and Disease Control Board, and such books of accounts shall be open and available at all times for inspection by any person appointed in that behalf by the Minister. * 1 G. 5 No. 26 and amending Act. Every Cane Pest and Disease Control Board Abouodkist ooff shall cause its books and accounts to be audited once Cane Pest at least in every calendar year by the Auditor-General aCnodntDroilsease or some auditor approved by the Auditor-General. Board. Statement (4.) Moreover each such Board shall, within such tfourbneished to period after the close of each calendar year as shall be Minister. prescribed, forward to the Minister a statement verified in the prescribed manner setting out the total sums received by such Board during such year and the amounts of all sums expended by such Board during such year in payment for pests, baits, fumigants, services, operations, or other matters or things as determined and sanctioned by the Minister upon the recommendation of the Advisory Board, and the amounts paid by the Board during such year in salaries, wages, allowances, bonuses, or other payments of a like nature, and stating in respect of such latter amounts the names of the persons who received same and the amounts respectively received. Every such Board shall cause a copy of the annual statement so forwarded as aforesaid to be published in some newspaper circulating in its area within fourteen days after such statement has been forwarded to the Minister. Penalty on (5.) Where any Cane Pest and Disease Control failure. Board fails to have an audit made as hereinbefore in this section prescribed, or fails to produce to the auditor all such books, accounts, vouchers, receipts, and other documents as he may reasonably require, or fails to forward to the Minister or to publish within the prescribed time the prescribed statement, or forwards to the Minister or publishes any such statement which is false in any material particular then, and in any such case, the secretary and every member of such Board shall each be guilty of an offence and liable to a penalty of not more than twenty pounds: Provided that it shall be a defence to any such member charged with an offence against this subsection to prove that the failure or falsification, as the case may be, which is the subject-matter of such charge occurred without his knowledge, connivance, or consent. Assessment [32.] (1.) In addition to any other assessment pro- fpourrpBoosaersd. vided for in this Act, the Minister may in each year make and levy an assessment of not more than six pence on every ton of sugar-cane received at any sugar mill

The provisions of section seven of this Act shall, so far as they are applicable, apply to the levy of every assessment made under this section. (2.) Upon receipt by the Minister of the nioneys raised in a cane pest and disease infested area by an assessment made and levied under this section, he shall cause such moneys to be transmitted to the Cane Pest and Disease Control Board for such area, to be used by them in carrying out the powers and duties vested in them. All moneys so received from the Minister by a Cane Pest and Disease Control Board shall be placed to the credit of the Board in an account which shall be operated upon by the chairman and secretary of the Board." 14. (1.) Section thirty-three of the Principal Act is Amendments amended as follows:- of s. 33. (a) In subsection one thereof the words" a cane- pest infested area or a cane-disease infested area" are repealed, and the words "a cane pest and disease infested area" are inserted in lieu of such repealed words. (b) In subsection two thereof the words and brackets" the Cane Pests Board (if any) or, as the case may be, the Cane Disease Control Board (if any) " are repealed, and the words "the Cane Pest and Disease Control Board" are inserted in lieu of such repealed words. (c) In subsection three thereof the words "Cane Pests Board or Cane Disease Control Board" are repealed where such words thrice occur and, in each such case, the words "Cane Pest and Disease Control Board" are inserted in lieu of such repealed words, and the word, figure, and letter " section 9E" are repealed and the words "subsections three, four, and five of section thirty-one" are inserted in lieu of such repealed word, figure, and letter. (2.) The amendments made to section thirty-three of the Principal Act by subsection one of this section shall come into force on and from the first day of April, one thousand nine hundred and forty-two.

Paragraph (a) of subsection one of section of s. 41 (1). forty-one of the Principal Act is repealed and the following paragraph (a) is inserted in lieu thereof, namely:- "(a) In any manner threatens, intimidates, obstructs, or impedes any person who is acting in the execution of any of the powers conferred by this Act or attempts so to do; or." Amendment 17. The words and brackets "(or in his absence of s. 43. from any cause, under the hand of the assistant secretary of such Central Board)" are inserted after the word and figures" 1915 to 1938 " in subsection five of section forty-three of the Principal Act, and, in addition the words and brackets "(or, as the case may be, the assistant secretary)" are inserted after the words " signature of the secretary" in the said subsection five. Amendments 18. Subsection one of section forty-nine of the ofs.49. Principal Act is amended as follows : - (a) In sub-paragraph (1) of the second paragraph thereof the words "which is" are repealed and the words "and/or any alternate host plants which is or are " are inserted in lieu thereof. (a) Paragraph (b) of the first proviso to subsection Amendments four of section twenty of the Principal Act (being the of s. 20 (4). paragraph beginning with the words "Not included" and ending with the words "to the mill ") is repealed, and the following paragraph (b) is inserted in lieu thereof, namely:- "(b) (If a meeting specially called for the purpose of cane-growers whose lands are assigned to the mill agrees in the prescribed manner to limit the number of the varieties of sugar- cane approved by the Director of Sugar Experiment Stations or if, in the event of such meeting having been duly requisitioned but not having been duly convened or having lapsed for want of a quorum or for any other reason, the Advisory Board constituted under *" The Sugar Experiment Stations Acts, 1900 to 1941," determines to limit such number) not included in the limited number so agreed upon or determined." (b) The following proviso is inserted after paragraph (b) of the first proviso to subsection four of section twenty of the Principal Act as previously inserted by this Act, namely :- " Provided further that, when a variety of sugar-cane is planted upon land assigned to a mill during a periodL- (i.) For which no limited number was agreed upon or determined under paragraph (b) of the first proviso to this subsection, and such variety was included in the varieties of sugar-cane approved by the Director of Sugar Experiment Stations; or (ii.) For which a limited number was agreed upon or determined under paragraph (b) of the first proviso to this subsection, and such variety was included in such limited number, all sugar-cane grown from such planting during the first, second, and third calendar * 64 V.
