( 2. ) The determination of the mill suppliers' committee to make the appeal or application shall be made at a special meeting of the committee called for that purpose at which no other bueiness shall be transacted. ( 3. ) The notice of motion instituting the appeal or the application and all other documents in the matter shall be under the signatures of the chairman and secretary of the mill suppliers' committee, and a state­ ment in writing signed by the aforementioned persons and setting out the date when the special meeting at which the committee made its determination to make the appeal or application was held and the resolution embodying the determination shall accompany such notice of motion. ( 4. ) The provisions of this section shall not prejudice any right had by a cane- grower or cane- growers or by any owner of a mill of appealing under section twelve or of applying under section 12A of this Act to the Central Board. Section thirty- five of the Principal Act is repealed and the following section is inserted in lieu thereof, namely : - , E. pt& ruacarsm. p, elofw' . osI\ aeernyst, s, " [35. ] ( 1. ) For the purposes of this Act the Central Board may, upon the application of the owner of a mill, make an Order granting to that owner an easement or other such interest upon any land for tramway, road, or other like purposes upon and subject to such terms and conditions and compensation, if any, as the said Board may deem just. Where, in connection with any such tramline, the mill- owner has constructed a bridge the sole and exclusive ownership thereof shall be and shall be deemed at all times to have been vested absolutely in such mill- owner. On any such alteration, the owner of the mill shall have the like easement in relation to the lands over which the tramline in its new position is laid down and constructed as he had in relation to the lands over which the tramline was, immediately prior to such alteration, laid down and constructed. ( 3. ) The owner of the mill shall from time to time if and when reasonably required by the owners of any lands on which any tramline referred to in this section is for the time being laid down and constructed, or by the owners of any lands adjacent thereto, provide construct and maintain at or near the boundaries of the lands of such owners such cattle grids, structures or other facilities as may be reasonably necessary to prevent livestock from straying over the tramline from the lands of one owner on to the lands of another. . soefcttiho [ 4 ins 2 t . Another Act Amendment Act of 1948 " shall, except in the case of any such member whose office is sooner vacated for any cause what­ soever, continue in office as such members until the day next preceding hthoelddinagteinfixtehdebyyeatrheoCneentthroaul sBaonadrdniannedhnuontdifrieedd ianntdhefif G ty a - z o e n tte e foofr tthhee first triennial election of representatives of the cane- growers and the owner or owners of the mill for appointment as members of the Local Board, but every such member shall be deemed to vacate• his office as such member on the day preceding such lastmentioned date. The cane-growers and the owner or owners of the mill shall, on the date fixed by the Central Board for each triennial election, elect by ballot their respective representatives in accordance with this Act for appointment as members of a Local Board. The first triennial election of such representatives for appointment as members of a Local Board shall be held during the year one thousand nine hundred and fifty-one and a triennial election shall be held during every third year thereafter. The date in any of such years for the triennial election of such representatives shall be fixed by the Central Board and notified in the Gazette. (b) The notification in the Gazette of the date fixed for anyelection under this clause shall also contain a day on or before which persons shall be nominated for such election. * This Act.

The names of the persons elected under this clause shall be filed in the office of the Central Board. If the secretary is satisfied that such persons have been duly elected, he shall forward a certificate to that effect to the Minister. · ( c) The secretary shall refer to the Central Board any matter of dispute arising with respect to any election under this clause and the Central Board shall inquire into the same. The Central Board may upon such inquiry order the secretary to forward the prescribed certificate, or order a fresh election, or make any other order in the premises as thought proper. Every such order shall be final and without appeal. The provisions of paragraphs (b) and (c) of clause ten and of clauses eleven and twelve of this Schedule, with all necessary modifications, shall apply to such an election. Any representative appointed as a member of a Local Board under . this clause shall hold office for the unexpired portion of the term of office of the members other than the chairman of that Local Board : Provided that if at any time any member of any Local Board 1s from illness, absence, or other cause prevented from attending any meeting ofthat Local Board the Governor in Council mayappoint some person to act temporarily as a member in his room, and while so acting such person shall have all the powers of and be deemed to be a member of such Local Board.
