Sugar Experiment Stations Acts Amendment Act of 1959 (8 Eliz II No. 65)

[A ssented to 22 nd D ecember , 1959.] B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. (1.) This Act may be cited as The Sugar Short title. Experiment Stations Acts Amendment Act of 1959.” (2.) The Sugar Experiment Stations Acts , 1900 to Principal 1957,” are in this Act referred to as the Principal Act. Aot' (3.) The Principal Act and this Act may be Collective collectively cited as The Sugar Experiment Stations 1 Acts, 1900 to 1959.”
474 Sugar Experiment Stations, Etc., Act . 8 E liz . II. No. 65, Amendment 2. Section two of the Principal Act is amended of s. 2. by repealing the definition “ Sugar-cane received ” and inserting, in lieu of that repealed definition, the following definition:— Sugar-cane received. “ “ Sugar-cane received ”—Any sugar-cane delivered at a sugar mill and accepted and paid for by the mill-owner, including any sugar-cane the property of the mill-owner so delivered and accepted for which the mill-owner would be liable to make payment had it been the property of and lawfully delivered to the mill by some other person.” Amendment 3. Section twenty-eight of the Principal Act is of s. 28. amended by repealing subsection nine and inserting, in lieu of that repealed subsection, the following subsections :—- (9.) It shall be an offence under this Act— (а) To remove from ; or (б) To plant or transplant in or on ; or (c) To deliver to any mill from, any plantation within any quarantine area any sugar-cane contrary in any respect to the provisions of any Proclamation or Order in Council unless such removal, planting, transplanting or delivery is permitted in writing by the Minister or an inspector and is made in compliance in every respect with the terms and conditions imposed by the Minister or, as the case may be, the inspector and specified in such permission (it being hereby declared that the Minister or an inspector may refuse any application for such permission or may grant same unconditionally or subject to such terms and conditions as he deems fit: Provided that the Minister may, either generally or in respect of any particular case, give directions as he deems fit with respect to the issue of permissions to which this subsection applies and every inspector shall observe any such direction).
1959. Sugar Experiment Stations, Etc., Act. (10.) Any person who in any respect contravenes or fails to comply with any provision of this section shall be guilty of an offence against this Act. In respect of the offences prescribed by subsection nine of this section persons shall be deemed guilty thereof and liable to be punished therefor as follows :— (a) In respect of any removal of sugar-cane contrary to that subsection, any person who made or caused to be made the removal and the occupier, or if there is no occupier, the owner of the plantation from which and the plantation to which the removal was made ; (b) In respect of any planting or transplanting of sugar-cane contrary to that subsection, any person who made or caused to be made the planting or transplanting and the occupier or, if there is no occupier, the owner of the plantation in or on which the planting or transplanting was made ; and (c) In respect of any delivery to the mill of sugar-cane contrary to that subsection, any person who made or caused to be made the delivery and the occupier or, if there is no occupier, the owner of the plantation from which the delivery was made. 475 4. Subsection four of section thirty-one of the Amendment Principal Act is amended by repealing the second °fs’31 paragraph thereof and inserting, in lieu of that repealed paragraph, the following paragraph :— “ Within fourteen days after so forwarding such statement every such Board shall notify by advertisement published in a newspaper circulated in its area that a copy of such statement may be inspected at the office of its secretary, stating the address of such office^ and shall cause such copy to be kept available for such inspection for six months after the date of the publication of such advertisement.”
476 Sugar Experiment Stations, Etc., Act . 8 E liz . II. No. 65,1059. Amendment 5. Section forty-four of the Principal Act is of e. 44. amended by adding the following paragraph :— “ The Board may from time to time invest any of its funds in any manner in which trust moneys may be invested by a trustee under The Trustees and Executors Acts, 1897 to 1924,” or any other Act, or on deposit with any bank or savings bank carrying on business in Queensland.”
