15144 SUGAR. Suga,r ]l}xperiment Stations, Etc., .Act (No. 2). 25 GEO. V. No. 26, Amendment of s. 11. 5. Section eleven of the Principal Act is amended as follows:- The third paragraph is repealed and the following paragraph is inserted in lieu thereof, namely:- " All Proclamations, Orders in Council, notifications, and regulations shall be published in the Gazette, and thereupon shall have the same force and effect as if they were embraced in and formed part of this Act and shall be judicially noticed and shall not be questioned in any proceedings whatever. All such regulations shall also be published in one or more approved newspapers circulating in the districts in which an assessment is made." In the fourth paragraph, after the word "regulations," the words "or Orders in Council" are inserted; also the words" both Houses of " are repealed. In the fifth paragraph, after the word " regulations," wherever occurring, the words" or Orders in Council " are respectively inserted; also the words ,~ either House of" are repealed. 25 N G o. eo 2 . 6 V . . E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as " The Sugar Experiment : ~ ~ struction Stations Acts Amendment Act of 1934 (No. 2)," and shall of Act. be read as one with *" The Sugar Experiment Stations Acts, 1900 to 1934," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Sugar Experiment Stations Acts, 1900 to 1934." Amendments of the Principal Act. New s. 7A. 2. A ? t , the MI' nl.St ~r m'ayf, 1 . so recommended bY ianssreessspmeecnttof the CommIssIOner for Public Health, In any year make and eradication levy a special assessment not exceeding three pence on of rats, every ton of sugar-cane grown within any approved area or locality and received at any approved sugar works. Such assessment shall be paid to the Minister in the first instance by the owner of every such approved sugar works upon the actual number of tons of such sugar-cane received during the season with respect to which notice of assessment has been given as hereinafter provided. But such assessment shall be paid and borne by the owner of the approved sugar works and the grower of the sugar-cane, respectively, in the following proportion, that is to say :- In respect of every ton of sugar-cane so received such owner shall pay two-thirds of the amount of such assessment, and such grower shall pay one-third of the amount of such assessment. Notice of such assessment shall be given to the owners of the approved sugar works, and such assessment shall be paid by them to the Minister on or before the thirty-first day of January following the date on which such notice is so given. The amount of such assessment shall be a debt due from the owner of the approved sugar works to the Minister, and may be recovered at the suit of the Minister or other person appointed by him in that behalf by action in any court of competent jurisdiction.: Provided that the owner of the approved sugar works shall be entitled to deduct from any moneys due by him to the grower of the cane the amount of such assessment payable by such grower, and such amount shall be and remain a charge upon such cane and the resulting sugar and by-products thereof, notwithstanding any change that may take place in the ownership of the same; or he may recover such amount fromsuch grower by action in any court of competent jurisdiction. Such special assessment shall be utilised in the eradication of rats affecting canefields, and shall be subject to such endowment as the Governor in Council may decide, which amount is hereby appropriated from the Consolidated Revenue for the purpose.
