45 %eettshxtt A NN O VICES IM O SEC UNDO E.IZA E AE SECUN D AE RE G I N AE No.11of173 Act to if end the Sugar E ent Stations Act 1900-1971 certain particulars [ASSENTED TO 11TH APRIL, 1973] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citati on. (1) This Act may be cited as the Sugar Experiment Stations Act Amendment Act 1973. (2) The Sugar Experiment Stations Act 1900-1971 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Sugar Experiment Stations Act 1900-1973.
46 Sugar Experiment Stations Act Amendment Act 1973, No. 11 2. A __ of s. 3c. Section 3c of the Principal Act is amended by adding to subsection (1) the following paragraph:- "The acquisition and holding of land by the Board may be as trustee for any person upon such trusts and with such powers in each case as the Governor in Council by Order in Council determines.". 3. of s. 3 H . Section 3M of the Principal Act is amended by, in subsection (1), in paragraph (a), (a) omitting the words " an Assistant " and inserting in their stead ords "a Deputy "; (b) omitting the proviso. 4. New s. 3N. Section 5 of the Principal Act is amended by omitting re word "Assistant " where it occurs and inserting in its stead in each case the word " Deputy ". s. 19. Section 19 of the Principal Act is amended by, in par, ,;: ) (i), inserting after the word " Commonwealth " the words " or tL Northern Territory of the Commonwealth ".
Sugar Experiment Stations Act Amendment Act 1973, No. 11 47 7. Repeal of and new s. 30. The Principal Act is amended by repealing section 30 and inserting in its stead the following section:- " 30. Cane Pest and Disease Control Boards. (1) The Governor in Council may by Order in Council upon the recommendation of the Director constitute a Cane Pest and Disease Control Board in and for any cane pest and disease infested area defined in that Order in Council. (2) Every Board shall consist of six members of whom- (a) three shall be cane-growers elected by the cane-growers of the area for which the Board is constituted; (b) two shall be representatives of mill-owners nominated by the mill-owners of the area for which the Board is constituted; (c) one shall be an officer of the Bureau of Sugar Experiment Stations appointed by the Governor in Council. (3) A cane-grower shall not be entitled to vote at an election unless he is at the material- time cultivating or ordinarily cultivates five acres at the least of assigned land for the purposes of the sale or supply of sugar-cane to a sugar-mill. (4) A person shall not be qualified to be elected or nominated as a member of a Board unless at the date of election or nomination, as the case may be, he is a cane-grower or the owner of a sugar-mill situated within the area for which the Board is constituted or a representative of that owner. A person shall be deemed to vacate his office as a member of a Board one month after he ceases to be qualified as prescribed by this subsection. (5) Every Board shall be constituted for three years or for such less period as the Governor in Council by Order in Council in any case determines. (6) Business shall not be transacted at a meeting of the Board unless four members at the least who are eligible to participate in that business are. present. (7) Where a Board has been constituted but the persons who are to be members thereof have not commenced their term of office, the Sugar Experiment Stations Board shall have, exercise and perform on behalf of the Board so constituted all the powers, functions, authorities and duties that may be conferred or imposed upon the Sugar Experiment Stations Board by the Governor in Council by Order in Council pursuant to section 3E. (8) The regulations may provide with respect to= (a) the time and manner of election and nomination of members of a Board ;
