392 QuzextslaU4 ANNO VICESIMO ELIZABETHAE SECUNDAE REGINAE No. 27 of 1971 An Act to Amend The Sugar Experiment Stations Acts 1900 to 1965 in certain particulars [ASSENTED TO 22ND APRIL, 1971 ] BE IT ENACTED by the Queen ' s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:-- 1. Short title and citation . (1) This Act may be cited as the Sugar Experiment Stations Act Amendment Act 1971. (2) The Sugar Experiment Stations Act of 1900 as amended from time to time is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Sugar Experiment Stations Act 1900-1971.

Sugar Experiment Stations Act Amendment Act 1971, No. 27 393 2. Amendment of s. 3D . Meeting, business, etc., of the Board. Section 3D of the Principal Act is amended by omitting the first paragraph of subsection (5) and inserting in its stead the following paragraphs:- " If the Minister or any other member of the Board will be unable to attend any meeting, the Minister may appoint in writing a person to attend that meeting in his room or, as the case requires, in the room of the other member in question. In the case of a member specified in paragraph (c) or (d) of subsection (2) of section 3A of this Act, the person appointed to attend a meeting in his room shall be appointed upon the nomination of the body whose nominee the member in question is.". 3. Amendment of s. 23 ( 2). Removal or introduction of sugar-cane in sugar - cane quarantine districts . Section 23 of the Principal Act is amended by inserting in subsection (2), after the words " free from disease ", the words " or cane pests ". 4. Amendment of s. 27. Abandoned land. Section 27 of the Principal Act is amended by inserting in subsection (2), after the words " any disease ", the words " or cane pest ". 5. Amendment of s. 28 . Quarantine Areas. Section 28 of the Principal Act is amended- (a) by omitting from subsection (9) the words " any plantation within any quarantine area any sugar-cane contrary in any respect to the provisions of " and inserting in their stead the following expression:- " any plantation within any quarantine area any sugar-cane, or (d) In the case of an owner of any mill, to accept delivery of any sugar-cane grown upon any such plantation, contrary in any respect to the provisions of, or the prohibitions expressed in,"; and (b) by inserting after subsection (9) the following subsections:- " (9A) Where the owner of any mill is guilty of an offence under subsection (9) of this section in relation to the acceptance of delivery of sugar-cane, the owner shall be liable to a penalty not exceeding one thousand dollars. (9a) Where the owner of any mill which is a corporation or association of persons is guilty of an offence under subsection (9) of this section in relation to the acceptance of delivery of sugar -cane then, in every such case, the chairman of directors, manager or other person controlling the business of the mill is also guilty of an offence and liable to the penalty specified in subsection (9A) of this section.". 6. Amendment of s. 34 . Notice to be given of appearance of disease. Section 34 of the Principal Act is amended- (a) by inserting, after the words " any disease ", the words " or cane pest "; and 94 ca(nbe)pbeystisn" serting, after the words " the diseases ", the expression

394 Sugar E xperiment Stations Act Amendment Act 1971, No. 27 7. Amendment of s. 35 . Power to require owner or occupier of land, etc., to destroy or prevent spread of disease . Section 35 of the Principal Act is amended by inserting, after the word " disease " (wherever occurring), the words " or cane pest ". 8. Amendment of s. 36 . Steps to be taken when land is infected. Section 36 of the Principal Act is amended by omitting the word " disease " and inserting in its stead the words " any disease or cane pest ". 9, Amendment of s. 44 . Expenses of Act. Section 44 of the Principal Act is amended by inserting, at the end of the second paragraph of subsection (1), the expression " , or in any form of investment that may be recommended by the Treasurer either generally or in a particular case (whether an authorized trustee investment or not), and shall not be invested in any other manner ".
