PR A O N B D ATE DUTIES ACTS [ASSENTED TO 10TH DECEMBER, 1935.] DECLA A R N A D TORY AMENDMENT . B E it enacted by the King's Most Excellent Majesty, ACT OF 1935. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as " The Succession and Short title. Probate Duties Acts Declaratory and Amendment Act of 1935," and shall be read as one with *" The Succession and Probate Duties Acts, 1892 to 1931," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as "The Succession and Probate Duties Acts, 1892 to 1935." 2. It is hereby declared that duties at the rates Deolaration mentioned in the Schedule to the Principal Act are and ~ e: : ing of always have been payable in respect of any real property cer~ iJ; l of a less tenure than an estate of freehold or any ~ ~ ~ ~ : : ~ ~ p~ { personal property whatsoever in Queensland or- any Act. interest therein belonging to any person who dies or has died after the first day of July, one thousand nine 4undred and eighteen, taken possession of or in any manner administered without the grant in Queensland of probate or administration or, if probate or administration of such property has been granted in any place outside Queensland, without the reseal in Queensland of such probate or administration, and that all such duties are and always have been payable to the same extent as they would be payable in respect of the grant in Queensland of probate or administration made in respect of the estate of such person. * 56 Vic. / 15610 SUCCESSION AND PROBATE DUTIES. Succession and Probate Duties, Etc., Act. 26 GEO. V. No. 27, 1935. It is hereby further declared that the Commissioner is and always has been empowered and authorised to assess and recover under the Principal Act duties at the rates mentioned in the Schedule thereto on all such property as aforesaid and notwithstanding that probate or administration of such property has not been granted in Queensland or, if probate or administration of such property has been granted in a place other than Queensland, notwithstanding that such probate or administration has not been resealed in Queensland. All such duties are and always have been payable, and the Commissioner is and always has been empowered and authorised to assess and recover all such duties not- withstanding that by reason of any other Act or law such property may be taken possession of or administered without the grant in Queensland of probate or administration or, if probate or administration of such estate has been granted in any place outside Queensland, without the reseal in Queensland of such probate or administration. Nothing in this section contained shall limit or prejudicially affect or be deemed to limit or prejudicially affect section lIB of the Principal Act: Provided that nothing in this section shall prejudice or affect the rights of any party to any judgment of any court of competent jurisdiction in any case where such judgment was given prior to the first day of August, one thousand nine hundred and thirty-five, nor prejudice or affect the rights of any party upon appeal from such judgment. In this section the term " Schedule to the Principal Act" shall mean and include the Schedule to *" The Succession and Probate Duties Act, 1892" (as amended by subsequent Acts). Amendment 3. Section twelve of the Principal Act is hereby of s. 12. amended by the addition to paragraph (d) of provision three thereof of the following words, namely :-" or for the costs incurred or which might be incurred in the conversion of all or any part of the property included in the succession by or on behalf of the successor." * 56 Vie. The Principal Act and this Act· may collectively be cited as " The Regulation oj Suyar Oane Prices Acts, 1915 to 1935." Amendments of the Principal Act. 2. Section four of the Principal Act is amended, Amendment. as follows:- oh. 4. The first proviso to subsection four, beginning with the words " Provided that" to and including the words " ten acres," is repealed and the following new proviso is inserted in lieu thereof:- " Provided that no cane-grower shall be entitled to more than one vote, and no cane-grower shall be entitled to vote unless he is a grower of cane from five acres or over of assigned land." * 59 Vie.
