285 ®urensfo:n()' ANNO UNDECIMO ELIZABETHAE SECUNDAE REGINAE ··••t••······~·······················'·············· No. 34 of 1962 An Act to Amend "The Succession and Probate Duties Acts, 1892 to 1961," in certain particulars [ASSENTED TO 19TH DECEMBER, 1962] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows: - 1. (1) Short title. This- Act may be cited as "The Succession and Probate Duties Acts Amendment Act of 1962." (2) Principal Act. "The Succession and Probate Duties Acts, 1892 to 1961," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as "The Succession and Probate Duties Acts, 1892 to 1962." 2. Amendments of s. 3 of 59 Vic. No. 28. Section three of "The Succession and Probate Duties Act 1892 Amendment Act of 1895" is amended by- (a) re-numbering such section as subsection ( 1); and
286 Succession and Probate Duties Acts Amendment Act of 1962, No. 34 (b) adding to it, as so re-numbered, the following subsection:- "(2) Duty paid by an executor or administrator in respect of a succession shall, to the extent of the value of the property or funds comprised in the succession actually received or disposed of by the successor, be reimbursed by such successor and any amount thereof not paid upon demand may be recovered by the executor or administrator by action as for a debt in any court of competent jurisdiction. The right of an executor or administrator under this subsection is additional to any other right had by him under any other provision of "The Succession and Probate Duties Acts, 1892 to 1962," in respect of any duty paid by him." 3. Repeal of s. 11 of 4 Edw. VII, No. 17. Section eleven of "The Succession and Probate Duties Act of 1904" is repealed.
