AND PROBATE [ASSENTED TO 14TH JANUARY, 1932.] DUTIES ACTS AMEND~ IENT --RE it enacted by the King's Most Excellent Majesty; ACT OF 1\)31. - - by and with the advice and consent of the Legis- lative Assembly of Queenslandin Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as " The Succession and Short titlg Probate Duties Acts Amendment Act of 1931" and shall ~ : ' qtruction be read as one with * "The Succession and Probate Duties of Act. Acts, 1892 to 1930," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The S'twcession and Probate Duties Acts, 1892 to 1931." Amendments of the Principal Act. 2. The Principal Act is amended as follows : - Am(md. mentH of the Prineipal Act. (i.) The first two paragraphs of section 100, beginning Section IOn. with the words "Where any policy" and ending with the words " shall lie on the donee" are repealed, and the following provisions are inserted in lieu thereof, namely ;- "Notwithstanding anything contained in this Act Moneys or in any other Act or law, practice, or usage to the pa~ able contrary, the moneys payable under any policy of ~ fe er insurance on the life of any person (whether such insl' :lr~ncc l.llsurance was effecte d b y t h e person lmse If or b y any po lCles. other person, and irrespective of any question as to who paid the premiums in respect of any such policy of insurance) shall on the death of the person on whose life such insurance was effected be deemed to be derived * 56 Vie. 13892 SUCCESSION. ---------- Succession and Probate, Etc., Amendt. Act. 22 GEO. V. No. 49, 1931. Ropoalof s. 19. by the person beneficially entitled to such moneys by way of succession from the person on whose death such moneys become payable who shall be deemed to be the predecessor. And it is hereby declared that the provisions of this section also apply to the moneys payable under any policy of life insurance which by instrument inter vivos has been assigned unless it be proved to the satisfaction of the Commissioner by the person in whose favour any such assignment may have been made that such assignment was for a bona fide adequate pecuniary consideration, and that all premiums paid in respect of the said policy since the date of the said assignment have been bona fide paid out of the proper moneys of such lastmentioned person and not otherwise. Nothing in the aforesaid provisions shall apply and extend to the moneys payable under any policy of insurance effected on the life of any person in any case where the amount of such moneys payable under the policy together with any amount payable under any other policy or policies effected on the said life to the wife of the person on whose life such insurance was effected does not exceed in the whole the sum of seven hundred and fifty pounds, and where it is proved to the satisfaction of the Commissioner that the wife of the person on whose life such insurance was effected is the person beneficially entitled on the death of the person on whose life such insurance was effected to the moneys payable under such policy and that such wife bona fide paid out of her own proper moneys all the premiums in respect of such policy of insurance."
