Subordinate Legislation (Repeal) Act 1985 (NSW)
An Act to repeal certain subordinate legislation; and for other purposes.
This Act may be cited as the Subordinate Legislation (Repeal) Act 1985.
In this Act:
(a) is in force at the date of assent to this Act,
(b) was made under an Act:
(i) by the Governor, or
(ii) by any other person or by any body and was required by the Act under which it was made to be approved or confirmed by the Governor or submitted for the approval of the Governor, and
(c) was published in the Gazette in pursuance of a requirement of any Act.
Where the citation, specified in Schedule 1, of any subordinate legislation has been changed before the date of assent to this Act, the citation so specified shall be read as a reference to the changed citation.
All subordinate legislation (other than that specified in Part A, or described in Part B, of Schedule 1) that, in pursuance of a requirement of any Act, was published in the Gazette on or before 31 January 1985 is repealed.
The Governor may by proclamation published on the NSW legislation website revoke the repeal of any subordinate legislation effected by section 3.
Any subordinate legislation the subject of a proclamation under subsection (1) shall be deemed not to be, and never to have been, repealed by section 3.
Subsection (2) does not operate in respect of any subordinate legislation so as:
(a) to affect in a manner prejudicial to any person (other than the State or an authority of the State) the rights of that person existing before the date of publication on the NSW legislation website of the proclamation under subsection (1) in respect of that subordinate legislation, or
(b) to impose liabilities on any person (other than the State or an authority of the State) in respect of anything done or omitted to be done before the date of publication of that proclamation.
