1Objectives
The objectives of these Regulations are—
(a)to prescribe instruments to be legislative instruments for the purposes of the Subordinate Legislation Act 1994;
(b)to prescribe instruments which are not to be legislative instruments for the purposes of that Act;
(c)to exempt certain legislative instruments from the operation of certain provisions of that Act.
2Authorising provisions
These Regulations are made under sections 4A and 28 of the Subordinate Legislation Act 1994.
3Commencement
(1)These Regulations, except item 118 of Schedule 1 and items 39, 47.12 and 94.3 of Schedule 3, come into operation on 28 June 2021.
(2)Item 118 of Schedule 1 comes into operation on 1 July 2021.
(3)Items 39, 47.12 and 94.3 of Schedule 3 come into operation on 1 July 2021.
4Revocation of Regulations
The following Regulations are revoked—
(a)the Subordinate Legislation (Legislative Instruments) Regulations 2011[1];
(b)the Subordinate Legislation (Legislative Instruments) Amendment Regulations 2012[2];
(c)the Subordinate Legislation (Legislative Instruments) Amendment Regulations 2013[3];

5Definitions
In these Regulations—
exempt legislative instrument means a legislative instrument specified in Schedule 3;
the Act means the Subordinate Legislation Act 1994.
6Instruments prescribed not to be legislative instruments
For the purposes of paragraph (h) of the definition of legislative instrument in section 3(1) of the Act, an instrument specified in an item in Schedule 1 is a prescribed instrument.
Note
Paragraph (g) of the definition of legislative instrument in section 3(1) of the Act provides that an instrument of purely administrative character is not a legislative instrument. Section 3(2) of the Act provides a non-exhaustive list of instruments which are of purely administrative character for the purposes of the Act.
7Instruments prescribed to be legislative instruments
(1)For the purposes of section 4A(1)(b) of the Act, an instrument specified in an item in Schedule 2 is prescribed to be a legislative instrument for the purposes of the Act.
(2)If the authorising Act of an instrument specified in an item in Schedule 2 provides that the instrument is a statutory rule for the purposes of Part 5 of the Act or a specified section of that Part of the Act, that instrument is exempt from complying with Part 5A of the Act.
8Exempt legislative instruments
For the purposes of section 4A(1)(c) of the Act, a legislative instrument specified in an item in Schedule 3 is exempt from the operation of the following provisions of the Act—
(a)Part 2A;
(b)Part 5A;
(c)section 16B;
(d)section 16C;
(e)section 16E;
(f)section 16F.
9Emergency Management Act 2013—exempt instruments
For the purposes of section 4A(1)(c) of the Act, an Order made under section 74E(1), 74F or 74H(1) of the Emergency Management Act 2013 is exempt from the operation of the following provisions of the Act—
(a)Part 2A;
(b)Part 3A;
(c)Part 5A.
10Emergency Management Act 1986—exempt instruments
For the purposes of section 4A(1)(c) of the Act, the following instruments made under the Emergency Management Act 1986 are exempt from the operation of Parts 2A, 3A and 5A of the Act—
(a)a declaration under section 23(1);
(b)a revocation or variation of a declaration under section 23(2);
(c)a direction under section 24(2)(a);
(d)a declaration under section 24(2)(b);
(e)a declaration under section 24(4).

The Subordinate Legislation (Legislative Instruments) Regulations 2021, S.R. No. 61/2021 were made on 22 June 2021 by the Governor in Council under sections 4A and 28 of the Subordinate Legislation Act 1994, No. 104/1994 and came into operation as follows:
All of Regulations (except item 118 of Schedule 1 and items 39, 47.12 and 94.3 of Schedule 3) on 28 June 2021: regulation 3(1); item 118 of Schedule 1 on 1 July 2021: regulation 3(2); items 39, 47.12 and 94.3 of Schedule 3 on 1 July 2021: regulation 3(3).
The Subordinate Legislation (Legislative Instruments) Regulations 2021 will sunset 10 years after the day of making on 22 June 2031 (see section 5 of the Subordinate Legislation Act 1994).
INTERPRETATION OF LEGISLATION ACT 1984 (ILA)
Style changes
Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.
References to ILA s. 39B
Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.
Interpretation
As from 1 January 2001, amendments to section 36 of the ILA have the following effects:
• Headings
All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.

• Examples, diagrams or notes
All examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).
• Punctuation
All punctuation included in a Statutory Rule which is made on or after
1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.

• Provision numbers
All provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after
1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).
• Location of "legislative items"
A "legislative item" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.
• Other material
Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).
