Subordinate Legislation (Legislative Instruments) Amendment Regulations 2024

PART 1—PRELIMINARY

1Objective

The objective of these Regulations is to amend the Subordinate Legislation (Legislative Instruments) Regulations 2021—

(a)to prescribe certain instruments not to be legislative instruments for the purposes of the Subordinate Legislation Act 1994; and

(b)to prescribe certain instruments to be legislative instruments for the purposes of the Subordinate Legislation Act 1994; and

(c)to exempt certain legislative instruments from the operation of specified provisions of the Subordinate Legislation Act 1994.

2Authorising provisions

These Regulations are made under sections 4A and 28 of the Subordinate Legislation Act 1994.

3Principal Regulations

In these Regulations, the Subordinate Legislation (Legislative Instruments) Regulations 2021[1] are called the Principal Regulations.

PART 2—SCHEDULE 1 AMENDMENTS

4Catchment and Land Protection Act 1994

Before item 15.1AA of Schedule 1 to the Principal Regulations insert—

"15.1AAAA statement of obligations under section 19E(1).".

5New item 15A of Schedule 1 inserted

After item 15 of Schedule 1 to the Principal Regulations insert—

"15A Caulfield Racecourse Reserve Act 2017

15A.1An event declaration under section 34(1) or (2).

15A.2A setting aside determination under section 35(2).".

6New item 24A of Schedule 1 inserted

After item 24 of Schedule 1 to the Principal Regulations insert—

"24A Drugs, Poisons and Controlled Substances Act 1981

7Electricity Industry Act 2000

Before item 30.1AA of Schedule 1 to the Principal Regulations insert—

After item 40.8 of Schedule 1 to the Principal Regulations insert—

"40.8AA direction under section 19FA.".

9Gas Industry Act 2001

Before item 44.1AA of Schedule 1 to the Principal Regulations insert—

"44.1AAAAn Order under section 24(1)(a) other than an Order that relates to a specific person.".

10Labour Hire Licensing Act 2018

In item 49.1 of Schedule 1 to the Principal Regulations, after "section 54(1)" insert "or (2)".

11Item 64 of Schedule 1 substituted

For item 64 of Schedule 1 to the Principal Regulations substitute—

"64 Marine Safety Regulations 2023

64.1A notice under regulation 9.".

12Item 65 of Schedule 1 revoked

Item 65 of Schedule 1 to the Principal Regulations is revoked.

13Transport Integration Act 2010

(1)After item 109.1 of Schedule 1 to the Principal Regulations insert—

"109.1AA direction under section 115Q(1)(b).".

(2) Item 109.13 of Schedule 1 to the Principal Regulations is revoked.

14New item 109A of Schedule 1 inserted

After item 109 of Schedule 1 to the Principal Regulations insert—

"109A Treasury Corporation of Victoria Act 1992

109A.1A notice given under section 36R(1).".

15Water Act 1989

After item 118.11 of Schedule 1 to the Principal Regulations insert—

"118.11AA statement of obligations issued under section 186A(1).".

PART 3—SCHEDULE 2 AMENDMENTS

16New item 2A of Schedule 2 inserted

After Item 2 of Schedule 2 to the Principal Regulations insert—

"2A Building Act 1993

2A.1A binding determination issued under section 206E(1).".

17Item 8 of Schedule 2 revoked

Item 8 of Schedule 2 to the Principal Regulations is revoked.

18Item 24 of Schedule 2 revoked

Item 24 of Schedule 2 to the Principal Regulations is revoked.

PART 4—SCHEDULE 3 AMENDMENTS

19New item 29A of Schedule 3 inserted

After item 29 of Schedule 3 to the Principal Regulations insert—

"29A Duties Act 2000

29A.1A declaration under section 3(2A).

29A.2Guidelines under section 55(3B).".

20Education and Training Reform Act 2006

(1)After item 31.6 of Schedule 3 to the Principal Regulations insert—

"31.6AA Ministerial Order under section 2A.1.5.

31.6BA Ministerial Order under section 2A.2.2(1).".

(2)After item 31.34 of Schedule 3 to the Principal Regulations insert—

"31.34AA Ministerial Order under section 5.10.4 setting out eligibility criteria for the purposes of section 2A.1.6(1).

31.34BA Ministerial Order under section 5.10.4 entitling employees to long service leave for the purposes of section 2A.1.9.

31.34CA Ministerial Order under section 5.10.4 specifying how a payment to be made to an employee in lieu of long service leave is calculated for the purposes of section 2A.1.10.".

(3)After item 31.38 of Schedule 3 to the Principal Regulations insert—

"31.39A Ministerial Order under section 5.10.4 for or with respect to a matter in clause 8A of Schedule 6.".

21Electoral Act 2002

After item 32.3 of Schedule 3 to the Principal Regulations insert—

"32.4   A determination made under section 207G for the purposes of the definition of claimable expenditure.".

22Item 39 of Schedule 3 revoked

Item 39 of Schedule 3 to the Principal Regulations is revoked.

23Land Tax Act 2005

After item 63.1 of Schedule 3 to the Principal Regulations insert—

"63.2Guidelines under section 75(1)(b).".

24Item 72 of Schedule 3 substituted

For item 72 of Schedule 3 to the Principal Regulations substitute—

"72 Marine Safety Regulations 2023

72.1A declaration under regulation 7.

72.2An approval under clause 5(k) of Schedule 1.".

25Planning and Environment Act 1987

After item 86.2A of Schedule 3 to the Principal Regulations insert—

"86.2BDirections issued under section 12A.".

26Road Safety Act 1986

After item 102.10 of Schedule 3 to the Principal Regulations insert—

"102.10AA notice under section 99C.".

27Service Victoria Act 2018

Item 109A.3 of Schedule 3 to the Principal Regulations is revoked.

28Water Act 1989

After item 127.11 of Schedule 3 to the Principal Regulations insert—

"127.11A   A restriction determination made under section 64FZC(1).

127.11BA prohibition determination made under section 64FZE(1).".

29Workplace Injury Rehabilitation and Compensation Act 2013

(1)For item 131.1 of Schedule 3 to the Principal Regulations substitute—

(2)After item 131.3 of Schedule 3 to the Principal Regulations insert—
