Subordinate Legislation (Legislative Instruments) Amendment Regulations 2023

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

PART 1—PRELIMINARY

1Objective

The objective of these Regulations is to amend the Subordinate Legislation (Legislative Instruments) Regulations 2021—

(a)to prescribe certain instruments not to be legislative instruments for the purposes of the Subordinate Legislation Act 1994; and

(b)to exempt certain legislative instruments from the operation of specified provisions of the Subordinate Legislation Act 1994.

2Authorising provisions

These Regulations are made under sections 4A and 28 of the Subordinate Legislation Act 1994.

3Commencement

These Regulations come into operation on 12 December 2023.

4Principal Regulations

In these Regulations, the Subordinate Legislation (Legislative Instruments) Regulations 2021[1] are called the Principal Regulations.

PART 2—SCHEDULE 1—INSTRUMENTS PRESCRIBED NOT TO BE LEGISLATIVE INSTRUMENTS

5Item 12 of Schedule 1 substituted

For item 12 of Schedule 1 to the Principal Regulations substitute—

"12 Bus Safety Act 2009

12.1A determination under section 29.

12.2Guidelines under section 44(5).

12.3Guidelines under section 57(1)(c).

12.4A code of practice approved under section 59(1). ".

6Catchment and Land Protection Act 1994

Before item 15.1 of Schedule 1 to the Principal Regulations insert—

"15.1AAA declaration under section 22A. ".

7New item 17A of Schedule 1 inserted

After item 17 of Schedule 1 to the Principal Regulations insert—

12Land (Regulated Watercourse Land) Regulations 2021

Items 51A.2, 51A.3, 51A.4, 51A.5, 51A.6, 51A.7, 51A.8, 51A.9, 51A.10, 51A.11, 51A.12 and 51A.13 of Schedule 1 to the Principal Regulations are revoked.

13Land Conservation (Vehicle Control) Act 1972

For item 52.1 of Schedule 1 to the Principal Regulations substitute—

"52.1An instrument setting aside areas of land in accordance with a regulation made under section 3.

52.2A proclamation under section 5(1).".

14Item 70 of Schedule 1 substituted

For item 70 of Schedule 1 to the Principal Regulations substitute—

18Catchment and Land Protection Act 1994

In item 18.3A of Schedule 3 to the Principal Regulations, for "notice" substitute "declaration published by notice in the Government Gazette".

19New item 21A of Schedule 3 inserted

After item 21 of Schedule 3 to the Principal Regulations insert—

"21A Circular Economy (Waste Reduction and Recycling) Act 2021

21A.1A Circular Economy Risk, Consequence and Contingency Plan (CERCC Plan) prepared, approved or varied under section 74B.".

20Drugs, Poisons and Controlled Substances Act 1981

After item 29.5 of Schedule 3 to the Principal Regulations insert—

"29.5A   An order under section 22J.

29.5BAn order under section 22M.".

21Electoral Act 2002

(1)After item 32.1 of Schedule 3 to the Principal Regulations insert—

"32.1A   Guidelines made under section 17A(2).".

(2)After item 32.2 of Schedule 3 to the Principal Regulations insert—

"32.3A determination made under section 110J(2)(d).".

22New item 33A of Schedule 3 inserted

After item 33 of Schedule 3 to the Principal Regulations insert—

23Essential Services Commission Act 2001

After item 41.2 of Schedule 3 to the Principal Regulations insert—

1 December 2021 and 31 December 2025, which, before being made, was an instrument referred to in section 76(1).

Note

Under section 76(1) of the Essential Services Commission Act 2001, certain instruments became Codes of Practice on 1 December 2021.".

24Heritage Act 2017

After item 55.2 of Schedule 3 to the Principal Regulations insert—

"55.2A   A notice under section 176(1).".

25Housing Act 1983

(1)In item 57.1 of Schedule 3 to the Principal Regulations omit "by the Director".

(2)After item 57.1 of Schedule 3 to the Principal Regulations insert—
