Subordinate Legislation (Legislative Instruments) Amendment Regulations 2022

The Governor in Council makes the following Regulations:

Part 1—Preliminary

1Objective

The objective of these Regulations is to amend the Subordinate Legislation (Legislative Instruments) Regulations 2021—

(a)to prescribe certain instruments not to be legislative instruments for the purposes of the Subordinate Legislation Act 1994; and

(b)to exempt certain legislative instruments from the operation of specified provisions of the Subordinate Legislation Act 1994.

2Authorising provisions

These Regulations are made under sections 4A and 28 of the Subordinate Legislation Act 1994.

3Commencement

(1)These Regulations (except regulation 5) come into operation on 27 September 2022.

(2)Regulation 5 comes into operation on 1 October 2022.

4Principal Regulations

In these Regulations, the Subordinate Legislation (Legislative Instruments) Regulations 2021[1] are called the Principal Regulations.

Part 2—Schedule 1 amendments

5Alpine Resorts (Management) Act 1997

For items 7.1 and 7.2 of Schedule 1 to the Principal Regulations substitute—

"7.1An alpine resorts strategic plan made under section 48(1). ".

6Casino Control Act 1991

Before item 14.1 of Schedule 1 to the Principal Regulations insert—

"14.1AAA direction under section 23.".

7Electricity Industry Act 2000

(1)Before item 30.1 of Schedule 1 to the Principal Regulations insert—

"30.1AAA determination under section 22 other than a determination that relates to a licence held by a specified entity. ".

(2)After item 30.3 of Schedule 1 to the Principal Regulations insert—

14Catchment and Land Protection Act 1994

After item 18.3 of Schedule 3 to the Principal Regulations insert—

"18.3A   A notice under section 58B(1).".

15Education and Training Reform Act 2006

(1)After item 31.12 of Schedule 3 to the Principal Regulations insert—

"31.12AA Ministerial Order under section 5.10.4 specifying relevant criteria for the purposes of sections 2.4.4(2) and 2.4.55.".

(2)After item 31.14 of Schedule 3 to the Principal Regulations insert—

16Environment Protection Act 1970

Item 38 of Schedule 3 to the Principal Regulations is revoked.

17Essential Services Commission Act 2001

(1)In item 41.1 of Schedule 3 to the Principal Regulations, for "section 33(5)" substitute "section 33".

(2)Item 41.3 of Schedule 3 to the Principal Regulations is revoked.

After item 43 of Schedule 3 to the Principal Regulations insert—
