Application to deal with contraventions involving dismissal.

[1] This matter concerns an application made by Mr Subhas Chandra (Mr Chandra) under section 365 of the Fair Work Act 2009 (the Act). The respondent is Thiess Services Pty Ltd (Thiess or the respondent).

[2] Mr Chandra made his application on 21 October 2013. The matter was listed for a conference to be held on 18 November 2013.

[3] Mr Chandra contacted the Commission regarding his application on 28 October 2013 and again on 30 October 2013

[4] On 6 November representatives of Thiess advised the Commission that they understood Mr Chandra had died.

[5] On 8 November 2013 Thiess provided the Commission with a copy of a proof of the death issued by the Coroner’s Court of Western Australia which advised that Mr Subhas Chandra, date of birth 4 April 1965 had died on 4 November 2013.

[6] On 11 November 2013 the Commission issued a notice of listing advising that the conference for 18 November 2013 had been cancelled and that further directions would be issued regarding this application.

[7] On 16 December 2013 the Commission issued a notice of listing advising that a hearing would be held on Friday, 7 February 2013. The notice of listing explained that information provided to the Commission indicated that Mr Chandra had died on 4 November 2013 and the hearing is to determine whether this application should consequently be dismissed.

[8] There has been no contact from Mr Chandra since 30 October 2013. There has not been any enquiry to the Commission regarding this matter from any person on behalf of Mr Chandra’s estate nor any other person associated with Mr Chandra.

[9] At the hearing of this matter on Friday, 7 February 2014 there was no appearance by any person on behalf of Mr Chandra’s estate nor any other person associated with Mr Chandra.

[10] The respondent has provided submissions explaining why in the circumstances they believe this application should now be dismissed.

[11] Considering the unfortunate circumstances of this matter and accepting the submissions of the respondent it is my decision that I should now exercise the power under section 587 of the Act and dismiss this application for want of prosecution.

[12] An order to that effect will be issued in conjunction with this decision.
