Student Assistance Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Student Assistance Act 1973.

Commencement of regulation 4

1. Regulation 4 shall be deemed to have come into operation on 1 January 1983.

Ineligible students: Awards not to be approved

2. Regulation 50a of the Student Assistance Regulations is amended by omitting “to be granted” and substituting “for”.

Eligibility

3. Regulation 51 of the Student Assistance Regulations is amended

(a) by omitting from sub-regulation (1) “An applicant” and substituting “A person”;

(b) by omitting from sub-regulation (1) “is not eligible to be granted an Award” and substituting “in respect of a period is not eligible for an Award in that period”;

(c) by inserting after sub-regulation (2) the following sub-regulation:

“(2A) In sub-regulation (1), ‘authority of Australia’ does not include a university or advanced education institution established under a law of Australia.”;

(d) by omitting from sub-regulation (3) “An applicant” and substituting “A person”;

(e) by omitting from sub-regulation (3) “to be granted” and substituting “for”;

(f) by omitting from sub-regulation (4) “An applicant” and substituting “A person”;

(g) by omitting from sub-regulation (4) “to be granted” and substituting “for”;

(h) by omitting from sub-regulation (5) “an applicant” and substituting “a person”;

(j) by omitting from sub-regulation (5) “to be granted” and substituting “for”;

(k) by omitting from sub-regulation (5) “the applicant” and substituting “the person”;

(m) by omitting from sub-regulation (6) “an applicant” and substituting “a person”;

(n) by omitting from sub-regulation (8) “an applicant” and substituting “a person”;

(p) by omitting from sub-regulation (9) “an applicant” and substituting “a person”; and

(q) by omitting from paragraphs (9) (a), (b) and (c) “applicant” and substituting “person”.

Eligibility

4. Regulation 51 of the Student Assistance Regulations is amended by omitting sub-regulation (7) and substituting the following sub-regulations:

“(7) A person who is in receipt of benefit or assistance granted or awarded in respect of a year, or part of a year, under a scholarship, bursary, prize or like award is not eligible for an Award in that year

(a) if the total value of benefit or assistance so granted or awarded

(i) by a donor other than Australia, an authority of Australia, a university or an advanced education institution; or

(ii) by a university, or an advanced education institution, which issues a certificate that the benefit or assistance was provided by a donor other than Australia, an authority of Australia, a university or an advanced education institution,

is more than $5,000; or

(b) if the total value of any other benefit or assistance so granted or awarded is more than $1,000.

“(7A) In sub-regulation (7), ‘donor’ includes the legal representative of a deceased donor.

“(7B) A certificate issued by a university or advanced education institution under sub-paragraph (7) (a) (ii) may be signed on its behalf by one of its officers.

 

“(7C) Nothing in sub-regulation (7) affects the operation of sub-regulation (1).”.
