Student Assistance Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Student Assistance Act 1973.

Interpretation—Part III

1. Regulation 29 of the Student Assistance Regulations is amended by omitting from sub-regulation (1) the definition of “relevant day” and substituting the following definition:

“ ‘relevant day’ means—

(a) in relation to a person who commences, or proposes to commence, in an academic year an approved course—the day in the academic year on which he commences that course; or

(b) in relation to a person who resumes or proposes to resume an approved course in an academic year subsequent to the academic year referred to in paragraph (a)—the day in the academic year on which he resumes that course;”.

Ineligibility—previous study and other academic reasons

2. Regulation 34 of the Student Assistance Regulations is amended—

(a) by omitting from sub-paragraph (1) (h) (i) “successfully completed before the relevant day represent one-half or less than one-half of a first” and substituting “undertook in that year and successfully completed before the relevant day represent one-half or less than one-half of a”;

(b) by omitting from sub-paragraph (1) (h) (ii) “successfully completed before the relevant day together represent one-half or less than one-half of the first” and substituting “undertook in those 2 years of study and successfully completed before the relevant day together represent one-half or less than one-half of”;

(c) by omitting from sub-paragraph (1) (h) (iii) “successfully completed in that last year of study” and substituting “undertook in that last year of study and successfully completed before the relevant day”;

(d) by omitting from sub-paragraph (1) (h) (iv) “successfully completed in those 2 years of study” and substituting “undertook in those 2 years of study and successfully completed before the relevant day”;

(e) by omitting from sub-paragraph (1) (h) (v.) “successfully completed in those 2 years of study” and substituting “undertook in those 2 years of study and successfully completed before the relevant day”; and

(f) by omitting from sub-paragraph (1) (h) (vi) “has successfully completed in those 2 years” and substituting “undertook in those 2 years of study and successfully completed before the relevant day”.
