Student Assistance Regulations (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Student Assistance Act 1973.

Commencement

1. (1) Regulation 8 shall be deemed to have come into operation on 4 December 1986.

(2) Regulations 2, 3, 4, 5, 6 and 7 shall be deemed to have come into operation on 1 January 1987.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Student Assistance Regulations.

Interpretation—Part III

3. Regulation 29 of the Principal Regulations is amended by inserting after paragraph (h) of the definition of “income” in subregulation (1) the following paragraph:

“(ha) as assistance with tuition fees payable under a scholarship in respect of a secondary student;”.

Ineligibility—benefit from the Commonwealth for education or vocational training

4. Regulation 33 of the Principal Regulations is amended:

(a) by inserting “, other than the Northern Territory” after “Territory”; and

(b) by omitting “granted for those purposes by an education institution” and substituting:

“granted:

(a) by an education institution; or

(b) by way of educational assistance in respect of a child by virtue of that child being a child of a victim of a natural disaster or an industrial accident”.

Living allowance—students of independent status

5. Regulation 41 of the Principal Regulations is amended by omitting paragraph (7) (a) and substituting the following paragraphs:

“(a) educational assistance provided by the Commonwealth, a State or Territory in respect of a child by virtue of that child being a child of a victim of a natural disaster or an industrial accident;

(aa) benefit or assistance in respect of studies other than full-time studies in an approved course; or”.

Living allowance—students not of independent status

6. Regulation 42 of the Principal Regulations is amended by omitting paragraph (17) (a) and substituting the following paragraphs:

“(a) educational assistance provided by the Commonwealth, a State or Territory in respect of a child by virtue of that child being a child of a victim of a natural disaster or of an industrial accident;

(aa) benefit or assistance in respect of studies other than full-time studies in an approved course; or”.

Schedule 3A

7. Schedule 3A to the Principal Regulations is amended:

(a) by omitting from column 2 of item 7:

“Wife’s pension”

and substituting:

“Wife’s pension granted to a person

whose husband is an age pensioner”; and

(b) by adding at the end the following item:

“15. Wife’s pension granted to a person whose husband is an invalid pensioner

Division 5 of Part IV of the Social Security Act being the Division and Part as so renumbered under section 50 of the Social Security Amendment Act 1987”.

 

Schedule 6

8. Schedule 6 to the Principal Regulations is amended:

(a) by omitting from item 1 “32.8” and substituting “36.2”;

(b) by omitting from item 2 “31” and substituting “35”;

(c) by omitting from item 3 “25.5” and substituting “30.5”; and

(d) by omitting from item 4 “22.8” and substituting “26.1”.

Non-reduction

9. Where, in respect of a period that commenced on 1 January 1987 and ends before 1988, the amount of benefit under Assistance that would, but for these Regulations, have been payable in respect of a person exceeds the amount of benefit under Assistance payable in respect of that person in respect of that period under the Student Assistance Regulations as amended by these Regulations, there is payable in respect of that person an amount equal to the amount of that excess.
