(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Student Assistance Act 1973.

Commencement

1. (1) Regulation 10 shall be taken to have commenced on 26 January 1988.

(2) Regulation 11 shall be taken to have commenced on 4 December 1987.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Student Assistance Regulations.

3. After regulation 5 of the Principal Regulations the following regulation is inserted:

Meaning of “prescribed educational scheme”

“6. For the purposes of paragraph 31a (1) (d) of the Act, each of the following schemes is a prescribed educational scheme:

(a) the Aboriginal Study Assistance Scheme;

(b) the Aboriginal Secondary Assistance Scheme;

(c) the Assistance for Isolated Children Scheme;

(d) the scheme to provide an allowance known as the Adult Migrant Education Program Living Allowance;

(e) the scheme to provide an allowance known as the Maintenance Allowance for Refugees.”.

Interpretation—Part III

4. Regulation 29 of the Principal Regulations is amended:

(a) by inserting “student assistance, under the Veterans’ Children Education Scheme or” after “under” in paragraph (f) of the definition of “pension benefit” in subregulation (1);

(b) by omitting from subregulation (1) the definition of “prescribed educational scheme”;

(c) by omitting from subregulation (6) “, subject to sub-regulation 41 (3aa),”.

Independent status

5. Regulation 30 of the Principal Regulations is amended by inserting in subparagraph (2) (e) (v) “student assistance, under the Veterans’ Children Education Scheme or” after “granted under”.

Termination—end of year

6. Regulation 39 of the Principal Regulations is amended:

(a) by omitting “expires” and substituting “terminates”; and

(b) by omitting “36,”.

Disobedience to summons, etc.

7. Regulation 80 of the Principal Regulations is amended by omitting the penalty at the foot of the regulation and substituting the following penalty:

“Penalty: $1,000 or imprisonment for 3 months.”.

Notice to be given of certain matters affecting Assistance

8. Regulation 85 of the Principal Regulations is amended by omitting the penalty at the foot of each of subregulations (1), (1a) and (1b) and substituting the following penalty:

“Penalty: $1,000 or imprisonment for 6 months, or both.”.

Notice to be given of certain matters affecting an Award

9. Regulation 86 of the Principal Regulations is amended by omitting the penalty at the foot of subregulation (1) and substituting the following penalty:

“Penalty: $1,000 or imprisonment for 6 months, or both.”.

Schedule 1

10. Schedule 1 to the Student Assistance Regulations is amended by omitting:

“The Guild Teachers’ College”

 

and substituting:

“The Guild Teachers’ College

University of Technology, Sydney”.

Schedule 6

11. Schedule 6 to the Principal Regulations is amended:

(a) by omitting from item 1 “36.2” and substituting “40.1”;

(b) by omitting from item 2 “35” and substituting “38.8”;

(c) by omitting from item 3 “30.5” and substituting “33.8”;

(d) by omitting from item 4 “26.1” and substituting “28.9”.
