I, JULIA EILEEN GILLARD, Minister for Education make this Determination under paragraphs 356(1)(a) and 356(1)(c) of the Student Assistance Act 1973.

Part 1      Preliminary

  1. Name of Determination

  1. Commencement

This Determination commences on the day after it is registered.

  1. Amendment to Student Assistance (Public Interest Certificate Guidelines) Determination 2008

Schedule 1 amends the Student Assistance (Public Interest Certificate Guidelines) Determination 2008.

Schedule 1     Amendments

  1. Paragraph 6(1)(c), the Secretary is satisfied that the disclosure is for the purposes of the section or subsection of this Determination

Delete and replace

(c)    the Secretary is satisfied that the disclosure is for the purpose of section 7, 8, 9, 10, 11, 13 ,14, 15, 15A, 15B or subsection 12 (1) or (2) of this Determination.

Insert

15A         Establishment and operation of the Family Responsibilities Commission

(1)   Relevant information may be disclosed for the purpose of this section if the disclosure is necessary:

(a)    for the establishment of the Family Responsibilities Commission; or

(b)   to assist in the performance of the functions, or the exercise of the powers, of the Family Responsibilities Commission.

(2)   In this section, Family Responsibilities Commission means the Commission established by section 9 of the Family Responsibilities Act 2008 (Qld).

15B         Matters of relevance

(1)   Relevant information may be disclosed for the purpose of this section if the disclosure is necessary for the purpose of:

(a)policy development; or

(b)facilitating the progress or resolution of matters of relevance to a department that is administering the Student Assistance Act 1973, social security law or family assistance law.

(2)In this section:

social security law has the same meaning given by the Social Security Act 1991.

family assistance law has the same meaning given by the A New Tax System (Family Assistance) (Administration) Act 1999
