  1. An extension of time is required to enable this application for special leave to appeal to proceed. It is not apparent from the material relied upon in support of the application that there is any reason to doubt the correctness of the decision of the Court of Appeal of the Supreme Court of Queensland. The application for special leave to appeal should be dismissed. Accordingly, it would be futile to grant the extension of time required to enable the application to proceed.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
