803 ~uccnslattb ANNO UNDECIMO ELIZABETHAE SECUNDAE REGINAE ••••••••••••••••••••••••••••••••••••••••••••••••••• No. 12 An Act to Amend "The Stock Routes and Rural Lands Protection Acts, 1944 to 1961," and "The Barrier Fences Act of 1954," each in certain particulars [AsSENTED TO 27TH MARCH, 1962) B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. This Act may be cited as" The Stock Routes and Short title Rural Lands Protection Acts and Another Act Amendment Act of 1962." 2. This Act is divided into Parts as follows :- Parts of Act PART I-PRELIMINARY ; PART II-AMENDMENTS OF " THE STOCK ROUTES AND RURAL LANDS PROTECTION ACTS, 1944 TO 1961 " ; PART III-AMENDMENTS OF "THE BARRIER FENCES ACT OF 1954."
804 Stock Routes and Rural Lands, Etc., Act 11 ELIZ. II. No. 12, Interpre- tation of Part II Collective title PART II-AMENDMENTS OF " THE STOCK ROUTES AND RURAL LANDS PROTECTION ACTS, 1944 TO 1961" 3. (1) This Part of this Act shall be read as one with " The Stock Routes and Rural Lands Protection Acts, 1944 to 1961." (2) " The Stock Routes and Rural Lands Protection Acts, 1944 to 1961,'. and this Part of this Act may be collectively cited as " The Stock Routes and Rural Lands Protection Acts, 1944 to 1962." Amendments 4. Section six of " The Stock Routes and Rural 8 0 f G s. eo 6 . o V r 1 . Lands Protection Acts, 1944 to 1961," is amended by- No. 16 (a) adding to subsection (3) the following proviso :- " Provided that the Governor in Council, on the recommendation of the Public Service Commissioner, may, and it is hereby declared always could, pursuant to the provisions of "The Public Service Acts, 1922 to 1960," exclude any appointee, or all appointees included in any class of appointees, under this Act from the operation of the whole or any specified provisions of "The Public Service Acts, 1922 to 1960," including the regulations thereunder, and either for a specified time or without limit of time, and that, to the extent to which any appointee, or any class of appointees under this Act is for the time being, or has been at any time, so excluded, "The Public Service Acts, 1922 to 1960," or the regulations thereunder, do not apply, and never have applied, with respect to the office of such appointee or, as the case may be, the office of any appointee included in such class of appointees." ; and (b) in subsection (4) omitting the words "Every such appointee " and inserting in their stead the words "Save to the extent to which an appointee under this Act is for the time being excluded from the operation of "The Public Service Acts, 1922 to 1960," and the regulations thereunder, every such appointee". Interpre- tation Collective title PART III-AMENDMENTS OF " THE BARRIER FENCES ACT OF 1954 " 5. (1) This Part of this Act shall be read as one with" The Barrier Fences Act of 1954." (2) "The Barrier Fences Act of 1954," and this Act may be collectively cited as "The Barrier Fences Acts, 1954 to 1962."
1962 Stock Routes and Rural Lands, Etc., Act 805 6. Subsection (2) of section five of " The Barrier ~ O e~tfnt Fences Act of 1954," is amended by adding to paragraph s. ( c) the following proviso :- " Provided that the provisions of " The Public Service Acts, 1922 to 1960," and the regulations thereunder, do not apply, and it is hereby declared never have applied, to any officer- (a) whose appointment has not been made under such Acts; (b) to the extent to which such officer is, pursuant to the provisions of such Acts, excluded from the operation thereof by the Governor in Council upon the recommendation of the Public Service Commissioner ; or (c) holding in conjunction with his office under this Act any office under the Principal Act, to the extent to which such officer is, in respect of his office under the Principal Act, excluded for the time being from the operation of" The Public Service Acts, 1922 to 1960," and the regulations thereunder."
