This regulation may be cited as the Stock (Maximum Chemical Residue Limits) Amendment Regulation (No. 1) 1994 . ˙ Regulation amended 2. This regulation amends the order in council under the Stock Act 1915 gazetted on 16 September 1989 at pages 529–38. ˙ Omission of words of notification 3. Words of notification 1 omit . ˙ Replacement of paragraphs (1)–(5) 4. Paragraphs (1) to (5)— omit, insert ˙ Short title 1. This regulation may be cited as the Stock(MaximumChemicalResidue Limits) Regulation 1989 . ˙ Definitions 2. In this regulation— “column” means a column in the Schedule. “excess residue” means a residue more than the maximum residue limit. “maximum residue limit” see section 3. “warranted stock” means cattle, deer, goats, horses, sheep, swine or poultry. 1 See Reprints Act 1992 , section 42A.
s4 3 s4 Stock (Maximum Chemical Residue Limits) Amendment (No. 1) No. 412, 1994 ˙ Meaning of “maximum residue limit” 3. In this regulation— “maximum residue limit” means— (a) for tissue of stock stated in column 3—the concentration stated in column 2 of a chemical residue stated in column 1 for the tissue; or (b) for a secretion of stock stated in column 4—the concentration stated in column 2 of a chemical residue stated in column 1 for the secretion; or (c) for a product of stock stated in column 5—the concentration stated in column 2 of a chemical residue stated in column 1 for the product. ˙ Excess residues prescribed as a “disease”—Act, s 4(4) 4. An excess residue in a product, secretion or tissue of stock is a disease. ˙ Warranted stock and diseases for seller’s warranty—Act, s 20(11)(a) 5.(1) The warranty under section 20 of the Act applies to warranted stock. (2) An excess residue in a secretion or tissue of warranted stock is a disease to which the warranty applies. ˙ Evidence of chemical residues—Act, s 20(11)(b) 6. Proof of an excess residue in tissue or secretions of warranted stock, no more than 7 days after the stock was sold, is proof of breach of the warranty under section 20 for the stock, unless there is evidence to the contrary.
s5 4 s5 Stock (Maximum Chemical Residue Limits) Amendment (No. 1) No. 412, 1994 ˙ Tests and laboratories to be approved by Minister—Act, s 20(11)(b) 7. For the purposes of this regulation, evidence is not admissible about excess residues in warranted stock unless— (a) it is evidence about a test for residues done in a laboratory; and (b) the test and laboratory are approved for the purpose by the Minister.’. ˙ Amendment of Schedule 5.(1) Schedule, as heading— insert— MAXIMUM CHEMICAL RESIDUE LIMITS (2) Schedule— insert— ‘chlorfluazuron fluazuron 0.1 1.0 0.1 0.2 0.1 1.0 7.0 0.5 edible offal of cattle fat of cattle meat edible offal of poultry fat of poultry meat fat of cattle meat edible offal of cattle section 3’. cow’s milk eggs ’.
