Part 1—Preliminary
1—Short title
These regulations may be cited as the Stock Foods Regulations 1996.
2—Commencement
These regulations will come into operation on 1 September 1996.
3—Revocation
All regulations previously made under the Stock Foods Act 1941 are revoked.
4—Interpretation
In these regulations—
Act means the Stock Foods Act 1941;
agricultural chemical has the same meaning as in the Agricultural Chemicals Act 1955;
restricted animal material means material derived, wholly or in part, from a vertebrate but does not include milk, milk products, gelatine, tallow or extracted oils;
stock medicine has the same meaning as in the Stock Medicines Act 1939.
Part 2—Standards under section 7
5—Standards under section 7
This Part is made for the purposes of section 7 of the Act.
6—Foreign ingredients
The following are foreign ingredients relative to stock food:
(a)stock medicines;
(b)agricultural chemicals;
(c)the substances listed in Schedule 1;
(d)the substances listed in Schedule 2.
7—Stock medicines
(1)Stock food must not contain stock medicine unless administration of the medicine in stock food to stock of a kind or species for which the stock food is intended is within the purposes in respect of which the stock medicine is registered under the Stock Medicines Act 1939.
(2)If stock medicine is added to stock food, the stock food must contain the appropriate proportion or amount of stock medicine determined in accordance with the directions for use of the medicine.
8—Agricultural chemicals
Stock food must not be contaminated with an agricultural chemical of a kind prescribed for the purposes of section 24(8) of the Agricultural Chemicals Act 1955 to a level of contamination that exceeds that prescribed in relation to the chemical under that section.
8A—Restricted animal material in stock food
(1)Stock food intended for ruminants must not consist of, contain or be derived from restricted animal material.
(2)Stock food intended for stock other than ruminants or dogs must not consist of, contain or be derived from restricted animal material derived from a placental mammal unless that material has been treated or processed in a manner approved by the Chief Inspector (within the meaning of the Livestock Act 1997) as rendering it suitable for animal consumption.
9—Schedule 1 substances
(1)Stock food must not contain any of the substances listed in Schedule 1.
(2)Subregulation (1) does not apply in relation to stock food intended for stock of a kind or species expressly excepted in Schedule 1.
10—Schedule 2 substances
(1)If a substance in respect of which a minimum permitted level is specified in Schedule 2 is added to stock food, the stock food must contain at least that minimum level of the substance.
(2)Stock food must not contain more of a substance in respect of which a maximum permitted level is specified in Schedule 2 than that maximum level.
Part 3—Labelling of stock foods
10B—Label or invoice on sale of stock food
(1)For the purposes of section 5(2)(d) of the Act, if a label or certificate relating to stock food to which this regulation applies does not contain a statement indicating that it is only for consumption by non-ruminant species, the label or certificate must include—
(a)a statement about whether or not the stock food consists of or contains mammalian material; and
(b)if it does consist of or contain such material—a statement indicating that it must not be fed to ruminants.
(2)A statement referred to in subregulation (1) must be displayed prominently on the label or invoice certificate.
(3)This regulation only applies to stock food—
(a)that consists of or contains material from animals other than fish or birds; and
(b)that is not supplied as food for dogs or pigeons; and
(c)that was produced or manufactured before 20 December 2001.
10C—Label or invoice on sale of stock food containing restricted animal material
(1)For the purposes of section 5(2)(d) of the Act, if stock food manufactured or produced on or after 20 December 2001 is, contains or is derived from restricted animal material, the following statement must be prominently displayed on the label or invoice certificate:
This product contains restricted animal material DO NOT FEED TO CATTLE, SHEEP, GOATS, DEER OR OTHER RUMINANTS
(2)This regulation does not apply in relation to stock food intended for dogs.
10D—Label or invoice on sale of stock food not containing restricted animal material
(1)For the purposes of section 5(2)(d) of the Act, if stock food manufactured or produced on or after 20 December 2001 is not, does not contain and is not derived from restricted animal material, the following statement must be prominently displayed on the label or invoice certificate:
This product does not contain restricted animal material.
(2)This regulation does not apply in relation to stock food intended for dogs.
Part 4—Offences
11—Offences
(1)A person must not sell, offer or expose for sale, or have in his or her possession for sale stock food that does not comply with these regulations.
(2)A person must not mark or deface an invoice certificate so as to obscure the statement it is required by Part 3 to contain.

Revocation of regulations

Transitional etc provisions associated with regulations or variations

6—Transitional provision
(1)Part 3 of the principal regulations, as amended by these regulations, only applies in relation to stock food manufactured after the commencement of these regulations.
(2)Part 3 of the principal regulations, as in force immediately before the commencement of these regulations, continues to apply to stock food manufactured prior to the commencement of these regulations.
