STOCK. 19 GEO. V. No. 5, 1923. Stock Foois Act Amendment Act. 12261 STOCK. An Act to Amend "The Stock Foods Act of 19 NGoe. o. 5. V. 1919" in certain particulars. THE STOCK FOODS ACT [ASSENTED TO 4TH OCTOBER, 1928.] AMENDMENT " ACT OF 1928. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Stock Foods Short title Act Amendment Act of 1928," and shall be read as one ~ : 8truction. with *" The Stock Foods Act of 1919," herein referred to as the Principal Act. The" Principal Act and this Act may collectively be cited as "The Stock Foods Acts, 1919 to 1928." 2. The following amendments are made in the Principal Act, namely:- (i.) Section two of the Principal Act is amended as Amendment follows :_ of 8. 2. (a) The following provision is added to the definition of "By-products," namely:- "The term also includes any other commodity, By,ploducts. substance, material, or matter which the Governor in Council, by notification published in the Gazette, declares .to be by-:products for the purposes of this Act." (b) In the definition of " Label" the words "written Label. or" are deleted. (c) In paragraph (b) of the definition of "Mixed Mixed concentrated or prepared stock food , " the word "Any" ocor npcreenptarraetded at the commencement of the said paragraph is repealed, stock food. and the words "Any stock lick or mineral feed; also any" are inserted in lieu thereof. (d) The definition of " Officer" is repealed, and the following definition is inserted in lieu thereof:- " "Officer"-An inspector or analyst or any other Officer. officer appointed under this Act: the term includes any person either generally or specifically authorised by the Minister in writing." * 10 Gao. (e) Mter the word" by-products" in the definition of "Stock food," the words "and any stock lick or mineral feed " are inserted. This Act. (f) Mter the words "and all" in the definition of " This Act," the words "notifications and" are inserted. Amendment (ii.) Section three of the Principal Act is amended of B. 3. as follows:- (a) In clause one of the third paragraph, after the words "jar or bottle" the words "or metal container" are inserted. (b) In clause three of the third paragraph as afore- said, before the word "label" where it firstly occurs, the wocd "printed" is inserted. (c) Two new provisions are inserted after provision (c) of subdivision (iv.) of clause three of the third paragraph aforesaid, as follows:- (d) Maximum percentage of salt; and (e) In the case of stock licks or mineral feeds, the maximum percentage of salt. and the minimum percentage of the follow- ing constituents, viz., phosphoric acid ( P~ 05) ' lime, magnesia, iron, sulphur, iodine, and also the respective forms in which they respectively occur." Also, the word "and" in the said provision (c) is deleted. (d) Subdivision (v.) of clause three of the third para- graph aforesaid is amended by omitting the words" In the case of mixed stock foods or prescribed stock foods" (occurring at the commencement of the subdivision), and inserting in lieu thereof: "In the case of all stock foods that are by this Act required to be labelled," Amendment (iii.) Section five of the Principal Act is amended of 8. 0. as follows:- (a) In paragraph {c) of subsection three, the word " label" is inserted before the word" invoice." (b) The following new subsection is inserted after subsection three of the said section, as follows:- " (4.) Any person who sells any stock food which upon analysis under this Act is found to contain- (i.) A lesser percentage than any minimum percentage; or

A greater percentage than any maXImum percentage, as is certified on the label attached to the stock food concerned, when such difference in percentage, in either case, amounts to more than five per centum of the amount as is certified on the label to be present, shall be guilty of an offence against this Act." (iv.) Section seven of the Principal Act is amended Amendment as follows;- of B. 7. In subsection one of the said section, the words "gross weight" are repealed and the words "total net weight" are inserted in lieu thereof; Also, in paragraph (d) of subsection two of the said section, the words "gross weight" are repealed and the words "total net weight" are inserted in lieu thereof. (v.) Section nine of the Principal Act is amended Amendment as follows;- of B. 9. In subsection two, the words "fifteen pounds" are repealed and the words "five pounds" are inserted in lieu thereof; also, the words " thirty pounds" are repealed and the words "ten pounds" are inserted in lieu thereof. (vi.) After section twelve of the Principal ActNew section the following section is inserted ;__ I2A. "[12A.] (1.) The Governor in Council may from Inspectors. time to time appoint inspectors and analysts, and such &c. other officers as may be necessary for the purpose of giving effect to or for the convenient carrying out of this Act. (2.) No officer shall have any monetary interest Officer not directly or indirectly in the manufacture or sale of any~ othav~ . .stock food, 'or in any trade or business connected there- :t!r;;ac:u.e with. Every officer who violates this provision shall be ~ s~ ~ of d. dismissed by the Minister and shall be disqualified for oc 00 reappointment. (3.) Any person who in any way obstructs or Obstruction interferes with any officer in the discharge of any of his of officers. duties or the exercise of any of his powers under this Aot shall be guilty of an offence against this Act. (4.) No officer shall be liable, except in respect of Protection wilful misconduct, to any legal proceedings for any- of officers. thing done or omitted in the exercise or execution of any of his powers or duties under this Act."
12264 STOCK. Stock Food8 Ac~ Amendment Act. 19 GEO. V. No. 5, 1928. Amendment of s. 16. (vii.) Section sixteen of the Principal Act is amended as follows:- Regulations. (a) In the first paragraph, all words from and including "all" to and including "effect" are repealed and the following words are inserted in lieu thereof :- " regulations providing for all or 'any purposes, whether general or to meet particular cases, that may be con- venient for the administration of this Act or that may be necessary or expedient to carry out the objects and purposes of this Act, and where there may be in this Act no provision or no sufficient provision in respect of any matter or thing necessary or expedient to give effect to this Act, providing for and supplying such omission or insufficiency," (b) Mter provision (iv.) of the second paragraph of the said section the following provision is inserted:- Degree of fineness, &0. " (iv A.) Prescribing the degree of fineness in stock foods and methods for sterilising bones and other animal products ; " (c) Mter the words "enacted in this Act "the words "and shall be judicially noticed and shall not be questioned in any proceedings whatever" are jnserted. (d) The words " both Houses of" where they twice occur are repealed. The words "either House of" are repealed; the words "such House" are repealed and the word "it" is inserted in lieu thereof.
