Explanatory note
Clauses 8 and 9 of the Stock Foods Regulation 1997 currently require stock food that is packaged to have attached to it a label containing a written statement regarding the contents or use of the stock food depending on whether or not the stock food contains ruminant tissue (that is, tissue or blood derived from the carcass of a ruminant animal). Clause 10 of that Regulation applies the same requirement to a written statement that is provided with bulk supplies of stock food.
The object of this Regulation is to amend the Stock Foods Regulation 1997 to instead provide that such written statements are to specify the contents or use of the stock food depending on whether or not the stock food contains mammalian material (that is, tissue or blood derived from the carcass of a mammal). This Regulation also makes it an offence to remove, alter, obliterate or deface a statement contained on a label attached to stock food, or to alter, obliterate or deface a written statement provided with stock food.
This Regulation is made under the Stock Foods Act 1940, including section 35
(the general power to make regulations) and sections 6 and 6A.

1 Name of Regulation
This Regulation is the Stock Foods Amendment (Mammalian
Material) Regulation 1999.
2 Commencement
This Regulation commences on 1 January 2000.

1.

[1] Clause 3 Definitions
Omit the definition of manufactured stock food from clause 3.
Insert instead in alphabetical order:manufactured stock food means stock food that has
undergone a manufacturing process.
ruminant means an animal that has a rumen, and includes an
animal belonging to any of the following classes of animal,
namely, cattle, sheep, goats and deer.

9 Labelling of packages of stock food: section 6
(1) A package of any manufactured stock food containing mammalian material must have attached to it a label that contains one of the following statements:
(a) the statement “This product contains mammalian material—DO NOT FEED TO CATTLE, SHEEP, GOATS, DEER OR OTHER RUMINANTS”, (b) the statement “This product contains mammalian material—DO NOT FEED TO RUMINANTS”, (c) the statement “DO NOT FEED TO RUMINANTS”, (d) the statement “For pig use only”, (e) the statement “For poultry use only”, (f) the statement “For pig and poultry use only”, (g) the statement “For (insert name of non-ruminant species) use only”. (2) A package of any manufactured stock food that does not contain mammalian material must have attached to it a label that contains one of the following statements:

(a)
the statement “This product does not contain mammalian material”,
(b) the statement “For pig use only”, (c) the statement “For poultry use only”, (d) the statement “For pig and poultry use only”, (e) the statement “For (insert name of species) use only”. (3) The lettering in any statement referred to in subclause (1) or (2):
(a) must be prominently located on the label in letters of at least 3 millimetres high, and (b) must be printed on a background of contrasting colour. (4) The label on which the statement appears must measure at
least 45 millimetres by 120 millimetres.(5) This clause does not apply to manufactured stock food that is supplied as food for an animal that does not produce, or is not to be used as, food for human consumption, including manufactured stock food that is supplied as pet food, as food for caged birds (other than poultry) or as food for ornamental fish. (6) This clause does not apply to packages of manufactured stock food that complied with clause 9, as in force immediately before its substitution by the Stock Foods Amendment (Mammalian Material) Regulation 1999.
(7) Subclause (6) ceases to have effect on 1 July 2000. (8) In this clause:
mammalian material means tissue or blood derived from the carcass of a mammal and includes any substance produced from or containing any such tissue or blood, but does not include the following:
(a) tallow or gelatin, (b) equine, porcine or macropod material. Note. Mammalian material includes meat, offal and rendered tissue. Milk products are not regarded as mammalian material as they are not tissue or blood derived from the carcass of a mammal.

9A Offence to remove or interfere with label: section 6 A person must not, without reasonable excuse, remove, alter, obliterate or deface, or cause or permit the removal, alteration, obliteration or defacement of, any label that is attached to a package of manufactured stock food in accordance with section 6 of the Act.
Maximum penalty: 10 penalty units.
