AN ACT to amend the Stock Diseases (Regulations)

Act, 1968-1976.

[Assented to 27th October, 1978.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Stock

Section 13

amended.

2. Section 13 of the principal Act is amended

(a)

as to subsection (1), by inserting after the word "section", where first occurring in line 2, the passage "and in section 13A";

(b)

as to subsection (3), by deleting the first eight lines and inserting in lieu thereof the passage "Without limiting the generality of subsection (2) of this section, the Governor may make regulations —" ; and

(c)

as to subsection (5), by deleting the passage "regulations.", in the last line, and inserting in lieu thereof a passage as follows

regulations, and regulations made pursuant to the powers conferred by this subsection shall take effect according to their tenor. .

3. The principal Act is amended by adding a new

section to stand as section 13A as follows:

13A. Notwithstanding that the Governor has not declared a state of emergency as provided by section 12, the powers conferred by section 10 for the making of regulations with respect to enzootic diseases are conferred for the making of regulations with respect to any one or more of the exotic diseases as though the provisions of that section were repeated in this section but with respect to any one or more of the exotic diseases, and regulations made pursuant to the powers conferred by this section shall take effect according to their tenor. .
