An Act to amend the Stock Diseases Act, 1923, with respect to the identification of stock and the constitution of the Board of Tick Control, [Assented to, 20th May, 1982.]

Stock Diseases {Amendment'}.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:-—

Short title.

1.           This Act may be cited as the “Stock Diseases (Amendment) Act,

1982”.

Commencement.

2.      (I) Except as provided by subsection (2), this Act shall commence

on the date of assent to this Act.

(2) Section 5, in its application to Schedule 2, and Schedule 2 shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

Principal Act.

3. The Stock Diseases Act, 1923, is referred to in this Act as the

Principal Act.

5.      The Principal Act is amended in the manner set forth in Schedules

1 and 2.

(1)

Section 3 ( 1 ) , definition of “Abattoir”-—

Omit the definition, insert instead;--

“Abattoir” means any premises used for the slaughter of stock or

for the processing of carcasses of .stock.

(2) Section 3 (3 )—

After section 3 (2), insert:—

(3) Where by any provision of this Act a person is required to do, or to refrain from doing, .some act or thing in relation to the sending of stock to an abattoir for slaughter or to a saleyard for sale, that provision shall be construed as requiring the person to do, or to refrain from doing, the act or thing, whether or not the abattoir or saleyard, as the case may be, is situated in New South Wales.

(Sec. 5.)

A m endm enis to the P r i n c i p a l Act Relating t o the Constitution o f

THE Board of T ick Control.

( I ) Section 5 (2) —

Omit the subsection, insert instead:—

(2) The board shall consist of—

(a)

a chairman, who shall be an oflicer of the Department of Agriculture;

(b)

6 persons owning stock within quarantine areas declared as such on account of the presence or suspected presence of cattle tick, 3 of whom shall be elected in the prescribed manner by such persons as may be prescribed; and

(c)

1 person, being a member of the Public Service Association of New South Wales and holding the prescribed qualifica­ tions, who shall be elected in the prescribed manner by—

(i) such persons appointed under this section; and

(ii)   such officers or temporary employees of the Depart­ ment of Agriculture,

as may be prescribed.

(2) Section 5 (8b) —

After section 5 (8 a) , insert:—

(8 b ) Section 39 of the Interpretation Act. 1897, applies in re.spcct

of the board as if this Act had been passed after the commencement

of the Interpretation (Amendment) Act, 1969.

SCHEDULE 3.

(Sec. 6.)

Savings and T ransitional Provisions.

Interprclalion.

1.

In this Schedule— “Board" means the Board of Tick Control constituted under the Principal Act.

,\ppointment of Board’s staff representative member and matters incidental llicrctn.

2. For the purpose of enabling the Board to be constituted as provided by the

Principal Act, as amended by this Act, and for any incidental purpose—■

(a)

section .“i. in its application to Schedule 2, and Schedule 2 shall he deemed to have commenced on the date of assent to this Act; and

(b)

the person first appointed to the Board by virtue of section 5 (2) (c) of that Act, as so amended, shall (subject to that Act, as so amended) assume office on the appointed day.

Term of olticc of the Board’s staff representative member.

3. Notwithstanding section 5 (4) of the Principal Act, the person first appointed to the Board by virtue of section 5 (2) (c) of that Act, as amended by this Act, shall (subject to that Act, as so amended) hold office until 31st December, 1984, but shall be eligible for reappointment.

Savings.

4.         Nothing in this Act affects the tenure of office of the members of the Board holding

office immediately before the appointed day.
