No. 4 of 1939.

AN ORDINANCE

To amend the Stock Diseases Ordinance 1933.

BE it ordained by the Governor-General in and over the Executive Council, in pursuance of the powers conferred by the Commonwealth of Australia, with the advice of the Federal Seat of Government Acceptance Act 1909-1938 and the Seat of
Government {Administration) Act 1910-1933, as follows:—

1.— (1.) This Ordinance may be cited as the Stock Diseases short title

Ordinance 1939. and dtatlon-

(2.) The Stock Diseases Ordinance 1933 is in this Ordinance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance, may be cited as the Stock Diseases Ordinance 1933-1939.

2. Section eight of the Principal Ordinance is amended by compensation

omitting sub-section (2.) and inserting in its stead the following destroyed

Sub-Sec t ion :— tatauctions

"(2.) Where any stock destroyed in pursuance of the last Director.

preceding sub-section was infected with a disease specified by the Minister by notice in the Gazette to be a disease for the purposes of this sub-section, the owner of the stock shall be entitled to com- pensation not exceeding one half of the fair market value of the stock so destroyed.".

3. Section nine of the Principal Ordinance is amended—• Powers of

(a) by omitting from paragraph (c) the word " a n d " ; and nspector-

(&) by adding at the end thereof the following para-

graph :—

" ; a n d

(e) order the disposal of any infected stock—

(i) for slaughter, under such supervision

as an inspector directs; or

(ii) under such conditions as an inspector

directs.".

4. Section eleven of the Principal Ordinance is amended— offences.

(a) by inserting in paragraph (c), before the word ''sells ", the words " except in pursuance of any order of an inspector,"; and

(b) by inserting after that paragraph the following para-

graph :—

"(ca) having acquired any infected stock disposed of in pursuance of an order given under paragraph (e) of section nine of this Ordi- nance, fails—

(i) to slaughter the stock under the super- vision directed by an inspector in pursuance of sub-paragraph (i) of that paragraph; or

(ii) to comply with any conditions

directed by an inspector in pur- suance of sub-paragraph (ii) of that paragraph;".
