Regulation 2000

Stock (Chemical Residues) Act 1975

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Stock (Chemical Residues) Act 1975.

Explanatory note
The objects of this Regulation are:

(a) to allow inspectors to make surveys, maps, plans or diagrams of land that may be the subject of a notice for the detention of chemically affected stock or of a prohibition or restriction on grazing, and
(b) to provide for data recorded under schemes of identification of stock established under the Stock Diseases Act 1923 to be used for the purposes of the Stock (Chemical Residues) Act 1975.

This Regulation is made under section 16 of the Stock (Chemical Residues) Act 1975, in particular, section 16 (6), which was inserted by the Stock (Chemical Residues) Amendment Act 1999.

1     Name of Regulation

This Regulation is the Stock (Chemical Residues) Amendment (Stock

Identification) Regulation 2000.

2 Commencement

This Regulation commences on 2 August 2000.

3 Amendment of Stock (Chemical Residues) Regulation 1995

The Stock (Chemical Residues) Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after clause 5:

5C Powers of inspectors to survey land

For the purpose of determining the particular land that may be the subject of a notice under section 7 or 8 of the Act, or of a notification under section 12 of the Act, an inspector may make a survey, plan, map or diagram of the land.

[2]     Clause 6

Omit the clause. Insert instead:

6     Data relating to the identification of stock

Data recorded under a scheme of identification of stock established under the Stock Diseases Act 1923 may be released under that Act for use for the purposes of the Stock (Chemical Residues) Act 1975.
