s1 4 s4 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ˙ Short title 1. This notice may be cited as the Stock (Cattle Tick) Amendment Notice (No. 1) 1997 . ˙ Notice amended 2. This notice amends the Stock (Cattle Tick) Notice 1993 . ˙ Amendment of s 4 (How object is to be achieved) 3. Section 4(a)— omit, insert— ‘(a) declaring certain areas in Queensland to be— (i) the infected area; or (ii) an eradication area; or (iii) a provisionally protected area; or (iv) a protected area; or (v) the free area; and’. ˙ Amendment of s 5 (Definitions) 4.(1) Section 5, definition “clean inspection” — omit. (2) Section 5— insert— ‘ “clean inspection” means a manual inspection of stock by an inspector that satisfies the inspector that all of the stock should be free of cattle tick. “eradication area” means a cattle tick eradication area. “provisionally clean property” means a property that— (a) is undertaking an approved program involving all stock on the property; and
s5 5 s6 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 (b) has had— (i) for the Central Queensland Cattle Tick Protected Area or North West Queensland Cattle Tick Protected Area—1 clean inspection under the program; or (ii) for the South Queensland Cattle Tick Protected Area, a provisionally protected area or an eradication area—3 clean inspections under the program.’. ˙ Replacement of s 10 (Stock from tick-free premises and racehorses and trotting horses) 5. Section 10— omit, insert— ˙ ‘ Exemptions from general requirement ‘ 10.(1) Stock to be introduced into the protected area need not undergo the inspection and treatment mentioned in section 9 if the stock— (a) for any stock— (i) are to be introduced from premises or a holding considered by the chief inspector to be free of cattle tick; and (ii) are conveyed directly to the protected area; or (b) for racehorses or trotting horses that are manageable, groomed horses—are to be conveyed directly to and from race meetings held in the protected area; or (c) for manageable, groomed horses— (i) are conveyed directly to and from a scheduled competition event; and (ii) are returned to the infected area within 5 days of entering the protected area.’. ˙ Amendment of s 13 (Movement of stock from first removed property) 6.(1) Section 13, heading, after ‘first removed’— insert—

(2) Section 16(1), after ‘first removed’— insert— ‘or provisionally clean’. (3) Section 16(3)(a), ‘without passing through the free area’— omit. ˙ Replacement of s 22 (Stock from tick-free premises and racehorses and trotting horses) 8. Section 22— omit, insert— ˙ ‘ Exemptions from general requirement ‘ 22.(1) Stock to be introduced into the protected area need not undergo the inspection and treatment mentioned in section 21 if the stock— (a) for any stock— (i) are to be introduced from premises or a holding considered by the chief inspector to be free of cattle tick; and (ii) are conveyed directly to the protected area; or (b) for racehorses or trotting horses that are manageable, groomed horses—are to be conveyed directly to and from race meetings held in the protected area; or

Section 26— omit, insert— ˙ ‘ Movement of stock from first removed or provisionally clean property ‘ 26.(1) Stock from a first removed or provisionally clean property that are to be moved to another place inside the protected area must undergo a clean inspection followed immediately by a supervised treatment. ‘ (2) However, stock that are to be conveyed directly to another first removed or provisionally clean property inside the protected area need only undergo a clean inspection.’. ˙ Amendment of s 29 (Movement of stock from first removed property) 10.(1) Section 29, heading, after ‘first removed’— insert— ‘ or provisionally clean ’. (2) Section 29(1), after ‘first removed’— insert— ‘or provisionally clean’. (3) Section 29(3), ‘without passing through the free area’— omit.

(2) Section 34(1)— insert— ‘(ea)for manageable, groomed horses— (i) are conveyed directly to and from a scheduled competition event; and (ii) are returned to the infected area within 5 days of entering the protected area; or’. ˙ Omission of s 35 (Conditional conveyance through protected area) 12. Section 35— omit. ˙ Amendment of s 39 (Movement of stock from first removed property) 13.(1) Section 39, heading, after ‘first removed’— insert— ‘ or provisionally clean ’. (2) Section 39(1), after ‘first removed’— insert— ‘or provisionally clean’. ˙ Replacement of s 44 (Movement of stock from first removed property) 14. Section 44— omit, insert—
s 15 9 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ˙ ‘ Movement of stock from first removed or provisionally clean property ‘ 44.(1) This section— (a) applies to stock that are to be moved— • from a first removed or provisionally clean property • to somewhere outside the protected area; but (b) does not apply to stock that are to be conveyed directly to an approved meatworks or to the infected area. ‘ (2) The stock must undergo a clean inspection followed immediately by a supervised treatment. ‘ (3) However, stock that are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards need only undergo a clean inspection.’. ˙ Amendment of s 49 (Alternative treatment) 15.(1) Section 49(1)(c), ‘an organised’— omit, insert— ‘a scheduled competition’. (2) Section 49(1)— insert— ‘(da)for manageable, groomed horses— (i) are conveyed directly to and from a scheduled competition event; and (ii) are returned to the infected area within 5 days of entering the free area; or’. ˙ Amendment of s 49D (Treatment and inspection requirements) 16. Section 49D— insert— ‘ (3) Also, manageable, groomed horses are exempt from subsection (1) if they—
s 17 10 s 18 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 (a) for racehorses and trotting horses—are conveyed directly to and from race meetings; or (b) for any horse— (i) are conveyed directly to and from a scheduled competition event; and (ii) are returned to the infected area within 5 days of entering the provisionally protected area; or’. ˙ Amendment of s 49G (Movement from property not undergoing approved program) 17. Section 49G(2)— omit, insert— ‘ (2) The stock must undergo— (a) a supervised treatment; and (b) a clean inspection followed immediately by a second supervised treatment at— (i) a clearing dip approved by the chief inspector; or (ii) a dip approved by an inspector.’. ˙ Replacement of s 49GB (Movement from infected property) 18. Section 49GB— omit, insert— ˙ ‘ Movement from infected property undergoing approved program ‘ 49GB.(1) This section— (a) applies to stock that are to be moved— • from an infected property undergoing an approved program • to somewhere outside the provisionally protected area; but (b) does not apply to stock that are to be conveyed directly to the infected area without passing through the free area.
s 18 11 s 18 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ‘ (2) The stock must undergo— (a) preliminary treatment; and (b) a clean inspection followed immediately by a supervised treatment at a dip approved by an inspector. ‘ (3) However— (a) stock that are to be conveyed directly to an approved meatworks need only undergo— (i) a visually clean inspection and plunge dipping; or (ii) a clean inspection; and (b) stock that are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards need only undergo a clean inspection. ˙ ‘ Movement of stock from infected property not undergoing approved program ‘ 49GBA.(1) This section— (a) applies to stock that are to be moved— • from an infected property not undergoing an approved program • to somewhere outside the provisionally protected area; but (b) does not apply to stock that are to be moved to an adjacent infected area without passing through any other property in the provisionally protected area. ‘ (2) The stock must undergo— (a) a supervised treatment; and (b) a clean inspection followed immediately by a second supervised treatment. ‘ (3) However, stock that are to be conveyed directly to the infected area without passing through a protected area, or the free area, need only undergo a clean inspection.’.
s 19 12 s 20 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ˙ Amendment of s 49GC (Movement from provisionally clean property) 19.(1) Section 49GC(2)(a), ‘, without passing through the free area’— omit. (2) Section 49GC(3)— omit. ˙ Insertion of new pt 7AA 20. After part 7A— insert— ‘ PART 7AA—CATTLE TICK ERADICATION AREA ‘ Division 1—Eradication area ˙ ‘ Declared eradication area ‘ 49GD.(1) The area marked ‘G’ in schedule 1 is declared to be an eradication area for cattle tick. ‘ (2) The areas are to be known as cattle tick eradication areas. ‘ (3) The exact location of the boundaries of each eradication area is held in digital electronic form. ‘ (4) The location of the boundary is also shown on maps held by the chief executive listed in schedule 2, part 7. 1 ‘ (5) The information held in digital electronic form can be reduced or enlarged to show the detail required for a particular area. 1 For information about the exact location of the boundary and the maps see note 1.
s 20 13 s 20 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ‘ Division 2—Preliminary treatment ˙ ‘ Preliminary treatment of cattle ‘ 49GE.(1) This section— (a) applies to cattle— (i) to be introduced into an eradication area from the infected area; or (ii) that are to be moved— • from an infected property in an eradication area • to somewhere outside the eradication area; but (b) does not apply to cattle that are to be conveyed directly to the infected area without passing through a protected area or the free area. ‘ (2) The cattle must undergo preliminary treatment. ‘ (3) An inspector may direct the owner of cattle to provide further preliminary treatment to the cattle before they undergo inspection if the inspector is not satisfied the cattle are free of cattle tick after— (a) consulting the owner; or (b) presentation of the cattle. ‘ (4) Without limiting subsection (3), an inspector is taken to be not satisfied the cattle are free of cattle tick if— (a) the inspector considers the preliminary treatment provided to the cattle is inadequate to ensure the cattle are tick free; or (b) no detail, or insufficient detail, of the preliminary treatment provided to the cattle is given to the inspector to enable the inspector to assess the treatment’s effectiveness.
s 20 14 s 20 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ‘ Division 3—Introduction of cattle into an eradication area ˙ ‘ General requirement ‘ 49GF.(1) Cattle to be introduced into an eradication area from the infected area must undergo a clean inspection followed immediately by a supervised treatment. ‘ (2) Subsection (1) does not apply to cattle that are conveyed directly through the eradication area— (a) to the infected area; or (b) to a clearing dip approved by the chief inspector. ‘ Division 4—Movement of stock to outside eradication area ˙ ‘ Movement of stock from infected property ‘ 49GG.(1) This section— (a) applies to stock that are to be moved— • from an infected property in an eradication area • to somewhere outside the eradication area; but (b) does not apply to stock that are to be conveyed directly to the infected area without passing through a protected area or the free area. ‘ (2) The person moving the stock must ensure the stock undergo a clean inspection followed immediately by a supervised treatment. ‘ (3) However— (a) stock that are to be conveyed directly to an approved meatworks need only undergo— (i) a visually clean inspection and plunge dipping; or (ii) a clean inspection; or (b) stock that are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards need only undergo a clean inspection.
s 21 15 s 23 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 ˙ ‘ Movement of stock from provisionally clean property ‘ 49GH.(1) This section— (a) applies to stock that are to be moved— • from a provisionally clean property in an eradication area • to somewhere outside the eradication area; but (b) does not apply to stock that are to be conveyed directly to the infected area or an approved meatworks. ‘ (2) The person moving the stock must ensure the stock undergo a clean inspection followed immediately by a supervised treatment. ‘ (3) However, stock that are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards need only undergo a clean inspection.’. ˙ Amendment of pt 7C, hdg (Movement of manageable groomed horses into New South Wales) 21. Part 7C, heading, ‘ horses ’— omit, insert— ‘ stock ’. ˙ Amendment of s 49K (Definition for pt 7C) 22.(1) Section 49K, heading, ‘ Definition ’— omit, insert— ‘ Definitions ’. s 24 16 s 25 Stock (Cattle Tick) Amendment (No. 1) No. 329, 1997 omit, insert— ˙ ‘ Conveying manageable, groomed stock into New South Wales ‘ 49L.(1) This section applies to manageable, groomed stock to be conveyed directly into New South Wales through the free area, a protected area or a provisionally protected area from— (a) the infected area; or (b) an infected property, first removed or second removed property, or provisionally clean property, in a protected area; or (c) a provisionally protected area; or (d) an eradication area. ‘ (2) Despite parts 4 to 7AA, if an inspector is satisfied the stock meet the entry conditions imposed under New South Wales law, the stock need not be inspected or treated.’. ˙ Amendment of s 53 (General dispensation of treatment requirements) 24. Section 53— insert— ‘ (2) Without limiting subsection (1)(a), the chief inspector may dispense with the inspection and treatment requirements for stock conveyed directly— • from the infected area or an eradication area • through a protected area on certain roads or railways approved by the chief inspector • to the infected area.’. ˙ Amendment of s 54 (Stock movements requiring a travel permit) 25.(1) Section 54(1), from ‘(’ to ‘)’— omit.
