s1 4 s4 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 ˙ Short title 1. This notice may be cited as the Stock (Cattle Tick) Amendment Notice (No. 1) 1996 . ˙ Notice amended 2. This notice amends the Stock (Cattle Tick) Notice 1993 . ˙ Replacement of s 2 (Commencement) 3. Section 2— omit, insert— ˙ Disease for which notice is made 2. This notice is made in relation to the disease cattle tick Boophilus microplus. ’. ˙ Amendment of s 5 (Interpretation) 4.(1) Section 5, heading— omit, insert— Definitions ’. (2) Section 5, definitions “Cattle Tick Free Area” , “Cattle Tick Infected Area” , “Central Queensland Cattle Tick Protected Area” , “infected area” , “North West Queensland Cattle Tick Protected Area” , and “South Queensland Cattle Tick Protected Area” omit . Section 7— omit, insert— ˙ Declared protected area 7.(1) The area marked ‘A’ in schedule 1 is declared to be a protected area for cattle tick. (2) The area is to be known as the central Queensland cattle tick protected area. (3) The exact location of the boundary of the area is held in digital electronic form. Section 15— omit, insert— ˙ Movement of stock from infected property 15.(1) Stock that are to be moved from an infected property to another place outside the protected area must undergo a clean inspection followed immediately by 1 supervised treatment. (2) However, if the stock are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards, the stock need not undergo the supervised treatment. (3) Also, if the stock are to be conveyed directly through the free area to an approved meatworks outside the protected area, the stock may, instead of the inspection and treatment, undergo— (a) a visually clean inspection and a plunge dipping; or (b) a clean inspection. (4) Further, if the stock from an infected property are to be conveyed directly to the infected area without passing through the free area, the stock— (a) are exempted from the operation of section 8; 2 and (b) need not undergo inspection or treatment.’. ˙ Amendment of s 16 (Movement of stock from first removed property) 7. Section 34— omit, insert— ˙ Alternative treatment 34.(1) Stock may be introduced into the protected area from the infected area without undergoing the inspection and treatment mentioned in section 33 if the stock— (a) are to be conveyed directly to an approved meatworks and will receive— (i) a visually clean inspection and plunge dipping; or (ii) a clean inspection; or (b) are cattle that— (i) have undergone the clean inspection; and (ii) are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards; or (c) come from premises or a holding considered by the chief inspector to be free of cattle tick and are to be conveyed directly to their destination; or (d) are manageable, groomed stock that have undergone the clean inspection and are to be conveyed directly to and from showgrounds, or another place where an organised event is to take place, approved by the chief inspector; or (e) are manageable, groomed racehorses or trotting horses that are to be conveyed directly to and from race meetings; or 5 For information about the exact location of the boundary and the maps see note 1.
s 13 10 s 13 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 (f) are horses that— (i) are maintained free of cattle tick by regular treatments approved by the chief inspector; and (ii) are to be conveyed directly to and from holdings approved by the chief inspector; or (g) are manageable, groomed horses that— (i) have undergone the clean inspection; and (ii) are to be conveyed directly to the infected area by passing through the protected area; or (h) are injured horses that— (i) have undergone the clean inspection; and (ii) are to be conveyed to a veterinary clinic for treatment; or (i) are manageable, groomed horses that— (i) have undergone a clean inspection; and (ii) a veterinary surgeon certifies, in writing, react adversely to chemical treatment. (2) If horses mentioned in subsection (1)(h) are not returned to the infected area within 3 clear days after they are introduced into the protected area, the horses must undergo a supervised treatment. (3) Horses mentioned in subsection (1)(i) must be returned to the infected area within 3 clear days after they are introduced into the protected area. (4) If a veterinary surgeon certifies, by written notice to an inspector, that a horse mentioned in subsection (2) reacts adversely to chemical treatment, the horse must undergo a clean inspection instead of the supervised treatment.’. ˙ Replacement of s 35A (Conditional conveyance to Taroom clearing dip) 13. Section 35A— omit, insert—
s 14 11 s 14 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 ˙ Conditional conveyance to Taroom clearing dip 35A.(1) Stock may be moved from the infected area to the Taroom clearing dip without undergoing the inspection and treatment mentioned in section 33 6 if the stock— (a) are conveyed directly through a protected area to the dip; and (b) use only a prescribed road to gain access to the dip; and (c) undergo a clean inspection and treatment at the dip. (2) In this section— “prescribed road” means— (a) the Theodore to Taroom section of the Leichhardt Highway; or (b) Cracow to Taroom Road; or (c) Fitzroy Development Road; or (d) Flagstaff Road; or (e) Broadmere Road. ˙ Conditional conveyance to Auburn clearing dip 35B. Stock may be moved from the infected area to the Auburn clearing dip without undergoing the inspection and treatment mentioned in section 33 7 if the stock— (a) are conveyed directly through a protected area to the dip; and (b) use only Auburn Road to gain access to the dip; and (c) undergo a clean inspection and treatment at the dip.’. ˙ Replacement of s 46 (Declared cattle tick free area) 14. (2) The area is to be known as the cattle tick free area. (3) The exact location of the boundary of the area is held in digital electronic form. (4) The location of the boundary is also shown on the maps held by the chief executive listed in schedule 2, part 4. 8 (5) The information held in digital electronic form can be reduced or enlarged to show the detail required for a particular area.’. ˙ Replacement of s 49 (Alternative treatment) 15. Section 49— omit, insert— ˙ Alternative treatment 49.(1) Stock may be introduced into the free area from the infected area without undergoing the inspection and treatment mentioned in section 48 9 if the stock— (a) are to be conveyed directly to an approved meatworks and will receive— (i) a visually clean inspection and plunge dipping; or (ii) a clean inspection; or (b) come from premises or a holding considered by the chief inspector to be free from cattle tick and are to be conveyed directly to their destination; or 8 For information about the exact location of the boundary and the maps see note 1. 9 Section 48 (General requirement)
s 16 13 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 (c) are manageable, groomed stock that have undergone the clean inspection and are to be conveyed directly to and from showgrounds, or another place where an organised event is to take place, approved by the chief inspector; or (d) are manageable, groomed racehorses or trotting horses that are to be conveyed directly to and from race meetings; or (e) are horses that— (i) are maintained free of cattle tick by regular treatments approved by the chief inspector; and (ii) are to be conveyed directly to and from holdings approved by the chief inspector; or (f) are injured horses that— (i) have undergone the clean inspection; and (ii) are to be conveyed to a veterinary clinic for treatment; or (g) are manageable, groomed horses that— (i) have undergone a clean inspection; and (ii) a veterinary surgeon certifies, by written notice to an inspector, react adversely to chemical treatment. (2) If horses mentioned in subsection (1)(f) are not returned to the infected area within 3 clear days after they are introduced into the free area, the horses must undergo a supervised treatment. (3) Horses mentioned in subsection (1)(g) must be returned to the infected area within 3 clear days after they are introduced into the free area. (4) If a veterinary surgeon certifies, by written notice to an inspector, that a horse mentioned in subsection (2) reacts adversely to chemical treatment, the horse must undergo a clean inspection instead of the supervised treatment.’. ˙ Insertion of new pts 7A–7C 16. s 16 14 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 PART 7A—CATTLE TICK ERADICATION AREAS Division 1—Eradication areas ˙ Declared eradication areas 49A.(1) The areas marked ‘E’ in schedule 1 are declared to be eradication areas for cattle tick. (2) The areas are to be known as cattle tick eradication areas. (3) The exact location of the boundaries of each eradication area is held in digital electronic form. (4) The location of the boundary is also shown on maps held by the chief executive listed in schedule 2, part 5. 10 (5) The information held in digital electronic form can be reduced or enlarged to show the detail required for a particular area. Division 2—Preliminary treatment ˙ Preliminary treatment of stock 49B.(1) Unless exempted by this notice, stock mentioned in sections 49C and 49E must undergo preliminary treatment. (2) An inspector may direct the owner of stock to provide further preliminary treatment to the stock before they undergo inspection if the inspector is not satisfied that the stock should be free of cattle tick— (a) after consultation with the owner of stock; or (b) on presentation of the stock. (3) Without limiting subsection (2), an inspector is taken to be not satisfied that the stock should be free of cattle tick if— 10 For information about the exact location of the boundary and the maps see note 1.
s 16 15 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 (a) the preliminary treatment provided to the stock is, in the inspector’s opinion, inadequate to ensure that the stock should be tick free; or (b) no detail, or insufficient detail, of the preliminary treatment provided to the stock is given to the inspector to enable the inspector to assess the effectiveness of the treatment. Division 3—Introduction of stock into an eradication area ˙ General requirement 49C. Stock to be introduced into an eradication area from the infected area must undergo a clean inspection followed immediately by a supervised treatment. ˙ Conditional conveyance through eradication area 49D. Stock may be conveyed through an eradication area from the infected area without undergoing the inspection and treatment mentioned in section 49C if the stock are conveyed directly through the eradication area— (a) to a destination in the infected area; or (b) to a clearing dip that is— (i) in a protected area; and (ii) approved by the chief inspector. Division 4—Movement of stock to outside eradication area ˙ Person moving stock to comply with division 49E. A person moving stock that are inside an eradication area in a way mentioned in sections 49F or 49G must comply with the section before the stock are moved.
s 16 16 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 ˙ Movement of stock from infected property 49F.(1) Stock that are to be moved from an infected property to another place outside an eradication area must undergo preliminary treatment and a clean inspection followed immediately by a supervised treatment. (2) If the stock are to be moved in a way, and to a place, mentioned in subsection (3), (4), or (5), the stock may be subjected to the requirements (if any) mentioned in the subsection instead of the inspection and treatment mentioned in subsection (1). (3) Stock that are to be conveyed directly to the infected area without passing through the protected areas or the free area— (a) are exempted from the operation of section 49B; 11 and (b) need not undergo inspection or treatment. (4) Stock that are to be conveyed directly to an approved meatworks may undergo— (a) a visually clean inspection and plunge dipping; or (b) a clean inspection. (5) Stock that are to be conveyed directly to Harristown Saleyards or Wandoan Saleyards by passing through the protected areas or the free area may undergo a clean inspection. ˙ Movement of stock from provisionally clean property 49G.(1) Stock that are to be moved from a provisionally clean property must undergo a clean inspection, followed immediately by a supervised treatment. (2) However, if the stock are to be moved in a way, and to a place, mentioned in subsection (3), (4) or (5), the stock may be subjected to the requirements (if any) mentioned in the subsection instead of the inspection and treatment mentioned in subsection (1). (3) Stock need not undergo a clean inspection and supervised treatment if the stock are stock conveyed directly to— 11 Section 49B (Preliminary treatment of stock)
s 16 17 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 (a) the infected area, without passing through a protected area or the free area; or (b) the infected area by passing through a protected area; or (c) an approved meatworks. (4) Stock that are to be conveyed directly to Harristown Saleyards or to the infected area by passing through the free area may undergo a clean inspection only. (5) Stock that are to be conveyed directly to Wandoan Saleyards by passing through a protected area or the free area may undergo a clean inspection only at the saleyard. (6) In this section— “provisionally clean property” means a property that is— (a) undertaking an eradication program; and (b) has a clean inspection under the program. PART 7B—MOVEMENT OF STOCK FROM APPROVED FEEDLOTS Division 1—Preliminary ˙ Definitions for pt 7B 49H. In this part— “approved interstate meatworks” means meatworks in another State approved under arrangements entered into between the chief inspector and a corresponding authority. “corresponding authority” means an authority of another State whose functions under the other State’s law correspond to the functions of the chief inspector.
s 16 18 s 16 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 ˙ Copy of approved interstate meatworks list must be available 49I.(1) A person may ask for a list of approved interstate meatworks at any office of the department dealing with stock. (2) An officer of the department at the office must comply with the request as soon as practicable. Division 2—Movement of stock ˙ Movement of stock from approved feedlot 49J.(1) This section applies to stock that are cattle or sheep only if the stock have been kept at an approved feedlot for a continuous period of at least 35 days. (2) Cattle may be conveyed directly without inspection or treatment to— (a) approved meatworks; or (b) Harristown saleyards or Wandoan saleyards; or (c) subject to any requirements of the other State, approved interstate meatworks. (3) Sheep may be conveyed directly without inspection or treatment to— (a) approved meatworks; or (b) Harristown saleyards. (4) Also, the sheep may be conveyed directly to another destination in the State if the sheep undergo a clean inspection. (5) However, this section does not apply to a movement of cattle or sheep from an approved feedlot in the infected area to a destination in the infected area if the movement is wholly within the infected area. (6) This section applies despite parts 4 to 7A.
s 17 19 s 17 Stock (Cattle Tick) Amendment (No. 1) No. 209, 1996 PART 7C—MOVEMENT OF MANAGEABLE GROOMED HORSES INTO NEW SOUTH WALES ˙ Definition for pt 7C 49K. In this part— “border” means the Queensland and New South Wales border. ˙ Movement of manageable groomed horses into New South Wales 49L.(1) This section applies to the movement of manageable groomed horses into New South Wales through the free area or a protected area from— (a) a place in the infected area; or (b) an infected property, first removed or second removed property in a protected area; or (c) an eradication area. (2) Also, this section applies only if an inspector is satisfied that the horses are to be conveyed to the border within 72 hours after the horses have been removed from the place mentioned in subsection (1). (3) If an inspector is satisfied that the horses meet the entry conditions imposed under New South Wales law, the horses may be conveyed to the border— (a) in the case of horses that will be conveyed to the border on the same day they have been removed from the place mentioned in subsection (1)—without inspection or treatment; and (b) in the case of horses that will be conveyed to the border within 72 hours after they have been removed from the place mentioned in subsection (1)—after undergoing a clean inspection.
