PART I - PRELIMINARY
CITATION
These Regulations may be cited as the Stock (Artificial Breeding) Regulations. (See back note 1)
INTERPRETATION
(1) In these Regulations, unless the contrary intention appears -
"imported semen" means semen which was not collected on premises within Australia;
"inherited defect" means a defect, deformity or malformation of a type included in Schedule 3;
"licensed inseminator" means a person licensed under regulation 17;
"licensed semen" means semen collected at premises licensed as a semen collection centre in accordance with regulation 7(3)(a) and "unlicensed semen" means semen which has not been so collected;
"maintenance test" means a test carried out in accordance with Part II of Schedule 2;
"preliminary test" means a test carried out in accordance with Part I of Schedule 2;
"premises" means a building and any associated outbuildings, structures and fences;
"premises licence" means a licence for the use of premises for the purpose of -
(a)the collection of semen at premises licensed as a semen collection centre in accordance with regulation 7(3)(a); or
(b)the storage and packing of semen of one species of stock;
"veterinary supervisor" means a veterinary surgeon appointed under regulation 3.
(2) The Chief Inspector may, if satisfied that they are heritable, by notice in the Gazette include additional defects, deformities or malformations in Schedule 3.
APPOINTMENT OF VETERINARY SUPERVISORS
(1) The Chief Inspector may appoint a veterinary surgeon as a veterinary supervisor to supervise the conduct of a specified licensed semen collection centre.
(2) A veterinary supervisor shall not carry out tests under regulation 9(a) and (b)(ii) in respect of a licensed semen collection centre of which he is the veterinary supervisor.
APPROVAL OF SIRE
(1) An application for approval of a sire shall be made to the Chief Inspector in Form 1 in Schedule 1.
(2) An examination by an authorized veterinary surgeon of a sire for which approval is sought shall include those tests listed in Part I of Schedule 2.
CANCELLATION OF APPROVAL
If the Chief Inspector notifies an owner of a sire that the approval of that sire has been cancelled, the owner shall return to the Chief Inspector the notice of approval of that sire.
USE OF IMPORTED SEMEN
An application for approval for the sale and use in the Territory of semen imported into Australia shall be made to the Chief Inspector in Form 2 in Schedule 1.
PART II - LICENSING OF PREMISES
APPLICATION FOR LICENCE
(1) An application for a licence for the use of premises for the collection, dilution, chilling, freezing, processing, storage and packing of semen for sale, or for the renewal or transfer to another person of such a licence, shall be made to the Chief Inspector in Form 3 in Schedule 1.
(2) Applications for the renewal of a premises licence shall be accompanied by the annual reports required to be made under regulation 11.
(3) A premises licence shall be in Form 4 in Schedule 1, and may be issued for either -
(a)the collection, dilution, chilling, freezing, processing, storage and packing of semen; or
(b)the storage and packing of semen of one species of stock.
CONDITIONS FOR ISSUE OF LICENCE
(1) A licence under regulation 7(3)(a) shall not be issued in respect of any premises unless those premises comply with the requirements of this regulation.
(2) Premises for which a licence is sought shall include a semen collection centre and a testing area, each of which is securely fenced by 2 separate fences at least 3 metres apart.
(3) Within a semen collection centre referred to in sub-regulation (2) there shall be -
(a)accommodation facilities for disease tested stock;
(b)facilities for the collection of semen from stock; and
(c)a production laboratory and storage facilities for semen derived from those stock.
(4) Stock other than that tested for disease in accordance with regulation 10 shall not enter a semen collection centre.
(5) Premises for which a licence is sought shall be so located that drainage or effluent cannot flow onto the premises from its surrounds.
(6) Premises for which a licence is sought shall be under veter-inary supervision to the satisfaction of the Chief Inspector.
(7) Premises for which a licence is sought shall be kept in a clean and functional condition to the satisfaction of the Chief Inspector.
MAINTENANCE OF HEALTH STANDARDS
The holder of a premises licence under regulation 7(3)(a) shall ensure that the premises are maintained as a health tested area as follows:
(a)stock shall, before being admitted to the premises, undergo preliminary testing in the testing area in accordance with Schedule 2;
(b)stock shall only be admitted to the semen collection centre -
(i)directly from the testing area; and
(ii)after satisfactory completion of preliminary testing;
(c)all stock within the testing area or the area of the semen collection centre shall remain within the boundaries of those areas at all times and in isolation from all other stock;
(d)stock within the area of the semen collection centre shall be subject to regular maintenance testing in accordance with Schedule 2;
(e)any male animal that fails to pass a maintenance test shall be withdrawn from the area of the semen collection centre and either put into an isolation area within the premises, pending further testing or treatment, or removed entirely from the premises;
(f)any semen already collected from a male animal which has failed to pass a maintenance test shall not be moved from the area of the semen collection centre without the permission of the Chief Inspector;
(g)male animals placed in isolation shall not be moved from isolation until all tests for the disease involved are satis-factorily completed;
(h)any female animal failing to pass a maintenance test shall be removed immediately from the premises;
(j)any stock found suffering from a disease not included in Schedule 2 shall be placed in an isolation area, and the Chief Inspector shall be notified immediately;
(k)the Chief Inspector shall determine whether any stock men-tioned in paragraph (j) is to be retested, treated or removed from the centre;
(m)any additional disease testing required by the Chief Inspector shall be carried out in the manner specified by him;
(n)equipment, including boots and clothing, used in activities involving contact with stock outside the premises shall be thoroughly washed and sterilized before being worn or brought into the premises; and
(p)semen extracted from male animals outside the semen collection centre shall not be processed at the semen collection centre.
RECORDS
(1) The holder of a premises licence under regulation 7(3)(a) shall ensure that the following records are kept in relation to the premises:
(a)the name, breed, tattoo, brand, earmarks, breed society registration number, date of birth and class of each animal brought onto the premises;
(b)the dates of movement of each animal to or from the premises;
(c)the particulars and date of any tests or treatments for disease which the animal is undergoing or has undergone;
(d)the particulars of any inherited defect found in a sire being used for semen collection, particulars of the sire or dam of that sire and any progeny or other relative of that sire;
(e)the marks or labels with which each dose of semen is labelled to identify the sire;
(f)the date of collection and the identity number assigned to each collection and batch of semen;
(g)the volume and density of the semen, the motility and morphol-ogy of spermatozoa in the semen, the degree to which the semen was diluted and the constituents of the diluent;
(h)the number of doses of semen preserved from each collection and batch;
(j)the details of each batch of semen received at, or despatched from the semen collection centre, including the address of the sender or receiver of the semen, the identity of the sire, the batch number and date of collection, and the premises at which the semen was collected from the sire;
(k)records of conception rates resulting from semen taken or despatched from licensed premises, identifying each batch of semen involved; and
(m)the date and method of disposal of any semen not otherwise accounted for.
(2) The holder of a premises licence under regulation 7(3)(b) shall ensure that the following records are kept in relation to the premises:
(a)the details of each batch of semen received at or despatched from the semen collection centre, including the address of the sender or receiver of the semen, the identity of the sire, the batch number and date of collection, and the premises at which the semen was collected from the sire; and
(b)the date and method of disposal of any semen not otherwise accounted for.
(3) Records kept in accordance with this regulation shall not be destroyed until the expiration of 5 years after the date on which they are made.
REPORTS
(1) The holder of a premises licence under regulation 7(3)(a) shall ensure that the following reports are forwarded to the Chief Inspector at the specified times:
(a)as soon as possible after the fact, notification regarding -
(i)the testing or treatment of animals on the premises and the results of such testing or treatment other than the routine treatment described in Schedule 5; and
(ii)the diagnosis of any disease identified on the premises;
(b)by 15 January in each year, annual reports for the period 1 January to 31 December of the previous year, in Form 5 in Schedule 6, signed by the veterinary supervisor, including -
(i)full details of any stock on the premises in respect of which evidence of an inherited defect has been observed;
(ii)certification that, with the exception of instances indi-cated in sub-paragraph (i), no evidence of inherited disease has been observed in stock on the premises or reported in stock bred therefrom;
(iii)full details of any stock at the centre which had not successfully completed health testing requirements during the period covered by the report, and the reason for retention of the animal; and
(iv)certification that, with the exception of instances indi-cated in sub-paragraph (iii), annual programmes for testing for disease have been completed successfully and all stock within the premises are free from evidence of infectious and contagious disease; and
(c)by 15 January in each year, annual returns for the period 1 January to 31 December of the previous year, in Form 6 in Schedule 1, including all receipts and disposals of imported semen, and the balance of imported semen held at the time of lodging the return.
(2) The holder of a premises licence under regulation 7(3)(b) shall ensure that an annual report is forwarded to the Chief Inspector in Form 6 in Schedule 1.
(3) The Chief Inspector shall forward to the Chief Veterinary Officers in all States of Australia the information derived from reports forwarded to him in accordance with this regulation, in Form 7 in Schedule 1.
PART III - PREPARATION AND STORAGE OF SEMEN
CLEANLINESS
(1) Equipment used at licensed premises for the collection, examination, dilution, chilling, freezing, processing, storage and packing of semen shall be cleaned and sterilized before each occasion on which it is used.
(2) Stock used as a decoy during the collection of semen shall be fitted with such appliances as may be necessary to prevent the transmission of venereal disease.
CONTAINERS FOR SEMEN
(1) Semen collected at licensed premises shall be placed in ampoules or in coloured straws, the colour of the straw and plug corresponding to that specified for the breed of the sire in Schedule 4.
(2) Ampoules and straws containing semen shall be labelled with the following information:
(a)the breed code, as specified in Schedule 4;
(b)the donor sire's identity code;
(c)the identity of the semen collection centre; and
(d)the batch number given in accordance with sub-regulation (3).
(3) Each separate collection and processing of semen from a donor sire shall be indicated by a separate batch number.
(4) Semen collected elsewhere than on licensed premises shall be placed in either ampoules or wine red coloured straws and shall be labelled "UL", together with the following information:
(a)the name of the owner of the donor sire;
(b)the donor sire's identity code;
(c)the identity of the semen collection centre; and
(d)the batch number.
(5) Processing of semen collected elsewhere than on licensed premises shall include treatment with antibiotics to the satisfaction of the Chief Inspector.
STORAGE OF SEMEN
(1) Licensed and unlicensed semen may be stored at licensed premises, subject to the following conditions:
(a)licensed semen shall not be stored in the same container or vessel as unlicensed semen;
(b)unlicensed semen from different origins shall be stored in separate vessels, unless the Chief Inspector has given per-mission, for the use of semen from different origins to be used on the same premises; and
(c)licensed semen placed in a vessel containing unlicensed semen shall become unlicensed semen, and shall be subject to the same restrictions on its distribution and use as apply to the unlicensed semen in that vessel.
(2) Licensed semen shall become unlicensed semen when it is removed from licensed premises, unless -
(a)it is moved directly to other licensed premises; or
(b)it is under the control of a licensed inseminator who shall ensure that such semen is not subjected to any treatment that is likely to adversely affect the quality of that semen.
INSPECTION OF SEMEN
(1) The person in control of a semen collection centre shall, when so requested by an inspector, make available, for quality evaluation, 2 doses of semen from each batch of licensed semen.
(2) An inspector may inspect semen supplied under sub- regulation (1) for quality.
(3) If the average assessment score for the semen inspected in a batch is less than the minimum standard or, if the semen is not made available for inspection, that batch of semen shall be declared unlicensed.
QUALITY AND STANDARD FOR SEMEN
In the case of bull's semen -
(a)the quality of semen shall be assessed, and expressed as 2 numbers -
(i)the first number representing the percentage of total spermatozoa which are showing movement; and
(ii)the second number representing the percentage of such moving spermatozoa which show no apparent morphological abnormalities and are progressing in a forward line at a speed which would not be considered abnormally slow for the circumstances applying; and
(b)the minimum standard for semen shall be set at the 30/30 level.
PART IV - LICENSING OF INSEMINATORS
APPLICATION AND ISSUE OF LICENCE
(1) A person may apply to the Chief Inspector in Form 8 in Schedule 1 for an inseminator's licence and such application shall state whether the applicant wishes to be licensed as a herdsman inseminator or as a commercial inseminator and be accompanied by -
(a)in the case of an initial application - evidence of training and experience in artificial breeding; and
(b)in the case of an application for renewal - a copy of the last annual report submitted in accordance with regulation 11.
(2) A licence shall not be issued by the Chief Inspector to an applicant unless that person has -
(a)attended a training course and passed an examination in the theory and practice of artificial breeding relevant to the application, as approved by the Chief Inspector;
(b)in the opinion of the Chief Inspector, adequate knowledge of the theory of, and satisfactory experience in the practice of artificial breeding relevant to the application; or
(c)an equivalent approval or licence issued by the Chief Inspector of one of the States.
(3) An inseminator's licence shall state whether the holder is licensed as a herdsman inseminator or a commercial inseminator and shall be in Form 8 in Schedule 1, and shall be current for a period, not exceeding 12 months, ending on 31 December in each year.
(4) The issue of -
(a)a herdsman inseminator's licence - entitles the holder to practise artificial insemination on his own stock or that of his employer only; and
(b)a commercial inseminator's licence - entitles the holder to carry out the work of collection, storage, dilution, chilling, freezing, processing and use of semen for, and the artificial insemination of, any stock.
(5) An application for renewal of an inseminator's licence shall be made within 14 days of the expiry of the licence.
RECORDS TO BE KEPT
(1) A licensed inseminator shall keep a written record of -
(a)the details of each batch of semen received or despatched by him, including the address of the sender or receiver of the semen, the identity of the donor sire, the batch number and date of collection and the premises at which the semen was collected from the donor sire;
(b)the details of inseminations performed by him, including the date of those inseminations, the identity of the stock, the name and address of the owner, the identity of the semen used and any information that is available on conception rates, including the number of services per conception;
(c)the date and method of disposal of any semen not otherwise accounted for; and
(d)the details of any semen collections performed by him outside a semen collection centre, including the date of collection, the name and address of the owner, the identity of the donor sires, the identity of each batch of semen, the number of doses of each batch and the use or destination of that semen.
(2) Records made in accordance with this regulation shall not be destroyed until the expiration of 5 years after the date on which they are made.
(3) Annual reports shall be forwarded to the Chief Inspector by a licensed inseminator and shall include -
(a)a record of inseminations performed during the year in Form 10 in Schedule 1, a copy of which shall be forwarded to the centre from which the semen was received; and
(b)a record of all imported semen received or despatched, in Form 6 in Schedule 1.
(4) A licensed inseminator shall keep a record of all collections of unlicensed semen in Form 11 in Schedule 1 that are to be moved from the property of origin and shall forward such record to the Chief Inspector as soon as possible after the semen has been moved.
18A. REGULATORY OFFENCES
An offence of contravening or failing to comply with regulation 5, 9 (other than paragraph (c), (k), (n) or (p)), 10, 11(1) or (2), 12, 13, 14(1), 15(1) or 18(1), (2) or (3) is a regulatory offence.
PART V - DISTRIBUTION OF SEMEN
MOVEMENT OF SEMEN
Subject to the Act and these Regulations, and notification by the Chief Inspector of restrictions on the movement of semen to or from a specified area in the Territory, licensed and imported semen may be moved or used anywhere within the Territory.
UNLICENSED SEMEN
(1) Unlicensed semen may not be stored on any premises other than -
(a)the premises at which the semen was collected;
(b)a semen collection centre, provided that the Chief Inspector has received notification of the collection and storage of that semen in Form 11 of Schedule 1; or
(c)on premises referred to in sub-regulation (2).
(2) Unlicensed semen may not be used on female stock except where such stock are -
(a)on the premises at which the semen was collected; or
(b)on premises specified by the Chief Inspector in Form 12 in Schedule 1, subject to the conditions described in sub- regulation (4).
(3) An application for the use of unlicensed semen on female stock not held on the premises at which the semen was collected shall be made in Form 13 in Schedule 1.
(4) The Chief Inspector may grant permission for the use of unlicensed semen on female stock not held on premises at which the semen was collected subject to the following conditions:
(a)the sire shall be derived from a tuberculosis-free herd or shall have passed a tuberculin test within the preceding 3 months;
(b)the sire shall be derived from a brucellosis-free herd or shall show a negative complement fixation test approved by the Chief Inspector within 28 days of collection, after which it shall remain in isolation from other stock until after collection has been completed;
(c)the sire shall be tested or treated for other diseases as prescribed by the Chief Inspector;
(d)the results of testing for tuberculosis, brucellosis and other diseases shall be submitted to the Chief Inspector with the record of collection in Form 11 in Schedule 1, signed by a veterinary surgeon;
(e)there shall be a limit on the number of doses and the period for which they may be used; and
(f)the owner of the sire shall keep a record of the distribution and use of the semen.

TESTS FOR FREEDOM FROM DISEASE
PART I - PRELIMINARY TESTING
The following tests will be carried out on stock in the admission centre and prior to introduction to the health tested area of the licensed premises:
Bulls and heifers
A clinical examination to reveal freedom from evidence of infec-tious or contagious disease and of inherited defects.
Bulls admitted to the licensed premises as calves shall be reported, on admission, free from inherited defects which are likely to be manifest in calves. Upon reaching sexual maturity, the bulls shall be reported free of all inherited defects.
With sexually mature bulls, a semen examination with satisfactory results as to sperm morphology, density, and motility and freedom from the presence of inflammatory products therein.
Brucellosis
Two complement fixation tests approved by the Chief Inspector will be conducted at 4 to 8 weeks intervals with negative results.
Leptospirosis
Two agglutination lysis tests at 4 to 8 weeks intervals against L. pomona with negative results (titre at less than 1 in 100). Cattle shall be subjected to an approved course of treatment with streptomycin after the completion of all testing for vibriosis and trichomoniasis. Cattle which give positive results to testing for leptospirosis may be accepted if additional tests, after treatment with streptomycin, show a stable or falling titre.
Tuberculosis
Two intradermal tuberculin tests using bovine tuberculin 8 weeks apart both with negative results, except that bulls deriving from herds declared by the Chief Inspector to be free from tuberculosis may be admitted after a single intradermal bovine tuberculin test with negative results.
Vibriosis
With bulls over the age of 5 months admitted to licensed premises, examination of preputial scrapings by culture and immuno-fluorescence on 4 occasions at weekly intervals when the bulls are sexually mature, with negative results.
With sexually immature bulls under the age of 5 months admitted to licensed premises this test to be waived. Instead, one mainten-ance test to be performed at the age of 10 months prior to first collection of semen.
Cows or heifers for use as teasers to be admitted at an age not greater than 5 months. Heifers, irrespective of age, to be drawn from herds either mated entirely for 2 years or more by artificial breeding or from herds in which all bulls for 2 years have shown negative on examination of preputial scrapings by culture and immunofluorescence.
All admitted cows or heifers must provide 4 negative cultures and agglutination tests of vaginal mucus at weekly intervals while in the licensed premises.
Trichomoniasis
With bulls over the age of 5 months admitted to licensed premises, examination of preputial scrapings by culture on 4 occasions at weekly intervals, when the bulls are sexually mature, with negative results.
With sexually immature bulls under the age of 5 months introduced to licensed premises this test to be waived. Instead, one maintenance test to be performed at the age of 10 months prior to first collection of semen.
Heifers, irrespective of age, to be drawn from herds either mated entirely for 2 years or more by artificial breeding or from herds in which for 2 years all bulls have shown negative cultures on examination of preputial scrapings. All introduced females must provide 4 negative cultures of vaginal mucus at weekly intervals while in the licensed premises.
Johne's Disease
Cattle shall be derived from properties and herds showing no evidence of Johne's Disease during the preceding 5 years. Alter-natively, cattle may be permitted entry to licensed premises after having been subjected to appropriate tests as prescribed by the Chief Inspector, with negative results.
Animals other than bulls and heifers
Steers for use as teasers to have been castrated before the age of 5 months and to undergo tests or treatments for brucellosis, leptospirosis and tuberculosis to the same standards as for bulls.
Working horses to be subjected to the tests or treatments for brucellosis and leptospirosis with the same standards as for cattle.
Poultry to be tested with avian tuberculin and by a tube agglutin-ation test for pullorum disease with negative results.
PART II - MAINTENANCE TESTING
After admission to the health tested area for licensed premises, stock shall be subjected to regular testing for freedom from disease and shall be expected to attain the following minimal standards:
Brucellosis
An annual complement fixation test approved by the Chief Inspector with negative results.
Tuberculosis
An annual retest with negative results.
Leptospirosis
An annual retest with results satisfactory to the Chief Inspector.
Vibriosis
With male cattle, an annual examination of preputial scrapings by culture and immunofluorescence with negative results.
With female cattle, a quarterly examination of vaginal mucus by culture and agglutination (VMA) test with negative results.
Trichomoniasis
With male cattle, an annual culture of preputial scrapings with negative results.
With female cattle, a quarterly culture of vaginal mucus with negative results.
