s1 2 s5 Stock Amendment (No. 2) No. 278, 1997 ˙ Short title 1. This regulation may be cited as the Stock Amendment Regulation (No. 2) 1997 . ˙ Commencement 2. This regulation commences on 1 October 1997. ˙ Regulation amended 3. This regulation amends the Stock Regulation 1988 . ˙ Omission of s 2 (Commencement) 4. Section 2— omit. ˙ Amendment of s 6 (Definitions) 5.(1) Section 6, definitions “animal matter” , “processed animal matter” and “treated animal matter” omit. (2) Section 6— insert— “meal” , for part 9, see section 68A. “ruminant material” , for part 9, see section 68A. “veterinary surgeon” see VeterinarySurgeonsAct1936 , section 3, definition “veterinary surgeon”. 1 ’. 1 VeterinarySurgeonsAct1936 , section 3 (Definitions), definition “veterinary surgeon”— “veterinary surgeon” means a person registered as a veterinary surgeon under this Act and whose name remains upon the register of veterinary surgeons.
s6 3 s8 Stock Amendment (No. 2) No. 278, 1997 ˙ Omission of pt 8 (Registration and control of piggeries) 6. Part 8— omit. ˙ Insertion of new s 68A 7. Part 9, before section 69— insert ˙ Definitions for pt 9 68A. In this part— “meal” means blood meal, meat meal, meat and bone meal and other meal made from rendered material of animal origin. “ruminant material” means tissues, including blood, from ruminants and meals obtained by rendering ruminant tissues, other than tallow.’. ˙ Replacement of s 75 (Feeding animal matter to stock) 8.(1) Section 75— omit, insert ˙ Feeding animal or contaminated matter to stock 75.(1) This section applies to stock, other than— (a) dogs or cats; or (b) caged pet birds, other than poultry; or (c) zoo or circus animals, other than ruminants or pigs. (2) A person must not— (a) feed animal matter or contaminated matter to stock; or (b) allow stock to consume or have access to animal matter or contaminated matter; or (c) possess animal matter or contaminated matter for stock feed. ‘(3) However, a person may—
s9 4 s9 Stock Amendment (No. 2) No. 278, 1997 (a) feed animal matter or contaminated matter to stock if the feeding is prescribed by a veterinary surgeon for disease control; or (b) use animal matter or contaminated matter in baits to destroy feral pigs or dingos; or (c) feed meal— (i) containing ruminant material to pigs or poultry; or (ii) that does not contain ruminant material to stock. 2 (4) In this section— “animal matter” means— (a) a carcass; or (b) matter derived from an animal, other than— (i) tallow or oil; or (ii) faeces; or (iii) milk or milk products manufactured from milk of Australian origin and processed in Australia. “contaminated matter” means refuse or residue that may contain or may have been in contact with animal matter. Example of contaminated matter Hotel or restaurant food scraps that may contain or may have been in contact with meat used in food preparation at the hotel or restaurant. ’. ˙ Insertion of new s 77 9. After section 76— insert— ˙ Ruminant feed restrictions 77.(1) A person must not feed ruminant material, compounded feed containing ruminant material or meal containing ruminant material to a ruminant. 2 However, the Agricultural Standards Regulation 1997 imposes labelling requirements for meal.
s9 5 s9 Stock Amendment (No. 2) No. 278, 1997 (2) A person must not feed compounded feed or meal to a ruminant if— (a) the feed or meal is labelled, or purports to be labelled, under the Agricultural Standards Regulation 1997 ; 3 and (b) the label, or purported label, contains a statement— (i) under the Agricultural Standards Regulation 1997 , section 42; 4 or (ii) that purports to be made under, or substantially complies with, that provision. (3) However, subsections (1) and (2) do not apply to feeding for approved research. (4) In this section— “compounded feed” means feed containing material of animal origin, whether or not it contains ruminant material.’. 3 For how feed or meal must be labelled, see the Agricultural Standards Regulation 1997 , part 4, division 2 (Labelling stock food) and part 5 (Labelling agricultural requirements). 4 The Agricultural Standards Regulation 1997 , section 42 (Statement label must contain). Under section 42(1), a label of stock food containing ruminant material must contain the following statement— ‘This product contains ruminant material—DO NOT FEED TO CATTLE, SHEEP, GOATS, DEER OR OTHER RUMINANTS.’. Section 42(2) has other provisions about how the statement must appear on the label.
